    Has the landlord written to you to state he is going to evict you?
    Is there anywhere else you can go?
    I would seek legal advice from CAB to be honest as well. Did you pay a deposit for the house?

    my sister in law will lend me money for another house because the landlord wont let us stay unless we clear the arrears.
    we have no deposit on the house either.
    the a&l continue to tell me that its my own problem and to go to the fos??

    Because it is a cash payment that could be one issue. Is there a tenancy agreement?
    Without that I think you are down the river without a paddle.

    Wonder if any of you out there can help me. Don't quite understand, but is it possible that if I put in a bank charges claim now to claim right up to the present day. Getting a bit confused with the stay holding at 2007????

    The stay period prevents the bank from using the limitation act(or 6 years argument) for bank charges cases from July 2001 to present. Hope that explains that you can reclaim July 2001 to now.

  • Well I have today received my list of charges stolen from my accounts by Halifax over the last fifteen months totalling £2058.00

    My claim letter will be written and sent by courier on Monday to ensure that they get it - as the Royal mail are on Strike :-(

    Just hoping that their cheque in FULL settlement is not too far away !

    Unfortunatly I dont think I can claim under the hardship rules but still at least my claim will be in the queue with all the others.

    Wish me luck....

    ....Update... Whiilst reviewing my list of charges sent throough by the Halifax I have realised that the charges total is £3073.00 ( which is alot as I have only had the accounts with the Halifax for 18 months).

    Initial claim letter sent by courier today asking for the refund....maybe, just maybe.

    I dont know if it is any help. I had my statement though and Im back where I started from paying £100 a month "Unofficial Overdraft Charges". I went down to my local branch of HSBc this afternoon with the statement and asked to see someone in customer services.

    First thing I asked is, how can I reduce the charges, could he reduce them so I can get my account back in the black. He said he couldn't but I could put a claim in online requesting the bank charges be reversed. He was unable to say if I would be successful or not.

    I asked how I could get myself out the rut without it costing me extra interest on loans etc. He came up with a couple of suggestions.

    a) Obviously - Spend less
    b) Shop around and see if i could get better deals on any direct debits.
    c) I didnt know this but HSBC charge £25 per transaction day that is beyond the overdraft.

    For example, I have 5 Direct debits scattered over the month. If the 2nd took me over my Agreed Over Draft, I will pickup a £25 charge for the day the transaction(s) occurred. However if I arrange all my DDs, SOs, Cash withdraws all in one day I will still be overdrawn to the same amount but I would only pickup a single £25 charge.

    This applies to all transactions leaving the account, be it standing orders, cash withdraws or direct debits

    Which account does the priority creditors take their money from? (mortgage or rent, council tax, utilities)
    You can be in financial hardship with one account but not with another one with another bank. If the bank charges from the account where you priority creditors take their money has made your arrears worse then aim at them and include notices or arrears plus income and expenditure forms.

  • i need some serious help, today i got the shock of my life, i realised that i don't have enough money to survive till i get paid in 4 weeks- what is killing me the most is £100 informal overdraft charge. this is not the first charge but i really can't afford it, im constantly in my overdraft and it seems like i go over my overdraft without realising it. im paying off a loan in ireland and a credit card and i just cant seem to survive. do you think that i would have a case to reclaim some of my charges back. today was a shock and it has made me realise that i cannot survive anymore and i need to sort my life out big time. please help me if you can.
  • hey just postin for abit of advice, and if i have a next step to go to.

    sent my letter off to HSBC 3-4 months ago, claiming financial hardship. They rang me to say they had received the letter but it had been put on hold, due to this investigation on fairness of the charges etc.

    I have council tax bills, utility bills, amongst other stuff building up due to the charges, not to mention im allready in debt.

    What can i do? any advice would help
