  • Are you able to reclaim Bank charges from business accounts? If so is it done the same as for private accounts? .....Thanks

Yes and no. Yes you can reclaim on business accounts but the process is slightly different. My understanding is that you are reliant on UCTA 1977 rather than UTCCR 1999

Possibly. With a lot of difficulty. To be able to advise properly would need to know if you have under 10 employees, £1 million turnover pa, and is it a sole trader account ? also which bank you are with ?

have a read on Legalbeagles and consumeractiongroup in their business forums to get a better idea of how to do these claims and what you are likely to be up against before doing anything further.

How was the wages paid? Was is BACS, Faster Payments, or cash?
By removing the money you ensured more charges went out the next month so it defeats the whole object of it all.
Did the statement show the time the money was withdrawn? Are you aware the debits show firstly prior to credits?

    wages paidd by bacs
yes we have reciept from the money being lifted at 19.23 on friday evening.
we had to lift the money because we had to survive! what was i meant to do? i have two small children to feed. anyways the b*tch that was dealing with our case told me that charges wouldnt come out but i wasnt taking any chances. good job i did take it out because they would have left me broke.
a&l have since come back and told me that they have looked at the last 12 months and do not consider me a financial hardship case??
they do however want to give me 95 quid in charges back again as a gesture of goodwill !
this will go a long way towards my rental arrears(2400.00)NOT!

not dealing with them anymore just going to go to the fos
is this the right thing to do??

    thanks for your responses

Yep, that is why I use quotes when I repost on here so that you know that I am answering your question. Apologies for not being more clearer.

Does the rent go out of the account you are reclaiming the charges from?
Is the arrears are £2400.00 have they not started eviction proceedings?

  • Well I have today received my list of charges stolen from my accounts by Halifax over the last fifteen months totalling £2058.00

My claim letter will be written and sent by courier on Monday to ensure that they get it - as the Royal mail are on Strike :-(

Just hoping that their cheque in FULL settlement is not too far away !

Unfortunatly I dont think I can claim under the hardship rules but still at least my claim will be in the queue with all the others.

    Wish me luck....
