    OK, they wrote saying that you would have to pay charges on the Saturday but how can the average guy conjure up extra cash just a few days before payday.
    It may well be that their charging periods work that way rather than any other reason.

    how can they change my statement transactions???
    my charges were due on saturday not friday, but the money my wife lifted on friday night was put on my statement on friday morning before my wages, hence making us look if we had went over our overdraft limit???

    How was the wages paid? Was is BACS, Faster Payments, or cash?
    By removing the money you ensured more charges went out the next month so it defeats the whole object of it all.
    Did the statement show the time the money was withdrawn? Are you aware the debits show firstly prior to credits?

  • I have previously succesfully claimed £1600 from natwest (in 2006) and found that they dealt with my claim very quickly - paid out in full within a few weeks.

    I have now decided to take on the Halifax. They have been dipping into my accounts (x2) every month and I have had enough.

    The Data protection letter went in about a month ago and I have now had the list of charges. They say they have taken £980 from me in the last year or so but upon closer inspection they have only responded to me in respect of one of my two accounts. The Data Protection letter covered BOTH.

    Just a word of warning there folks... if you are claiming for more than one account under the same DPA request make sure that the Banks' reply details ALL charges for ALL accounts.

    They call it a "mistake" but I'm not so sure!

    I will wait for the full response and upon receipt a claim will be in the post. I'll keep you updated as with the progress.
  • Are we allowed to claim the charges back? Natwest owe me over £4000.00 in charges for 3 x accounts...when is the ruling coming back...does anyone know? :o

    The next judgement is not about refunding of charges but only if the charges can be assessed for fairness.

  • I have gone down the hardship claim and have been offered approx £4500 of £6500 claimed

    If I accept does that mean I have no further claim if/when the Court Case judgement is finalised or could I accept and still claim the balance at a later date ??

    I am more than a little desperate now - which I guess they were hoping this would be the case

    Simply accept the offer they have given you by writing a letter to the bank stating that the offer is accepted as a PART PAYMENT and until the claim is made in full you will continue with your claim and pursue them through the courts if necessary.

    Ensure you don't sign anything that agrees to a "full and final settlement".

    :confused:

    No offer can be made in full and final settlement of the entirety of the claim. It can be for the financial hardship part. Everything else remains on the table until the conclusion of the OFT test case issues.

  • I am just about to send my bank charges letter away along with my list of charges to the halifax. Was just wondering what address i should send it too? my local branch ?
