Have you had any joy reclaiming them and did you just use the normal bank charge reclaim sheets? i've written to them about 2 charges and reported them to the financial ombudsman about these 2 but i want them all back. Am furious about the whole thing. I got charged £22 for going overdrawn by £1.20 for less than 24 hours. can anyone help?0

Hi, recently have went down the financial hardship route after months of struggling to meet monthly bills. Now am a months behind in rent, loans piling up, unpaid bills etc etc and have £7 in bank to last me and my kids 2 weeks. After a week or repeated calls to BOS/Halifax (computers down), ive been told that the case has been passed to collections (?) and that no decision has been made at this time. I intend to keep calling them for an update, but does anyone know how long this might take? They won't tell me over the phone.
Also i want to reclaim my charges on an old credit card which i paid off about two years ago. Am i still able to do this now that i no longer have an account (Capital One)?0 -
Hiya guys....just wondered if anyone had any luck claiming back charges that were "the reasonable" £12? Apparantly we can claim these back but few successes so far. If so Capital One owe me over £500 but i dont want to try and get it back and they laugh at me
as its the "reasonable amount"..
Thanks

That isn't what the OFT said, in fact, they said that only a court can decide a fair amount.0 -
Hi all, thought i would just let people know that if you're claiming financial hardship via HBOS and they tell you it has went to collections for a decision, the bank told me today that the turnaround period on them making a decision is 14 days from them receiving your financial statement. Just hope they stick to that!!! i'll keep you posted.

natweststaffmember is right (usually is, about most things!!!) also, I feel that the new Supreme Court is going to want to get off to a flying start by making an historic and meaningful judgement. If they hold in favour of the banks they'll just be written off as another establishment quango. Keep the faith - one thing I have learned through all of this reclaiming is that when you are bad with money - you ALWAYS feel that you're in the wrong and that you don't deserve just treatment. This is faulty thinking.
Question for natweststaffmember - I know the Supreme Court ruling is only part of the battle - I've checked their upcoming hearings and can find nothing on bank charges - have you any further info on this? The received wisdom was that the hearing would take place in October. If they find in our favour, I imagine that the OFT will move quickly - they've had enough time to think about it???? I wish all reclaimers well - let's hope we can look forward to a good 2010! I'd also like to nominte Martin for an honour - Queen's Birthday List next year???? If he'd stopped a mugger in the street and returned an old lady's pension - he'd get a gong - just think how many people are better off financially but more importantly emotionally on account of his advice!0 -

It funny you should ask about if the Supreme Court says yes. The view of Tom Brennan who took NatWest to court a few years ago and kinda won but lost ie got the charges back with interest but lost one aspect of the claim is here:

This is pretty much what could happen.0
