    Did u find out why you didnt win the case, sure martin would be interested in havin a chat to you. How long was the court case and what did the judge say did the bank turn up.

    If you have filed your claim on MCOL and you realise you have made a mistake and think 'Oh no what have I done' Do NOT panic, like i did recently after discovering they had duplicated 2 charges twice which i added in as i didnt notice the dates, plus I hadnt added the interest up correctly. You can rectify the problem either by applying for an amendment to claim norm costs about £35.00(to your county court) or you can add it to the further particulars of claim if it gets that far, or even add to the AQ, Yes I had to seek Legal Advice Yes its free as she is a litigation specialist and my best friend and if I can offer any help in the advice that she gives on this site then I will do so...It wouldnt hurt to also write an accompanying letter should you end up in court....The judges are human and they dont expect us lay people to be litigant experts or professional accountants, and they do make way for mistakes, just be sure you realise the error before you get to court.

  • Here is an odd one for anyone out there, I am just about to take Virgin One account to court for about £700 of charges. But....

    Virgin One Account is based in england but they are owned by RBS who have an Edinburgh address. SO do I need to try in the english courts or the scotish sherifs courts??? HELP
  • I've been given a court date of 26 July.

    The court has asked me to deliver copies of all documents (including any experts' reports) on which I intend to rely at the hearing no later than 14 days before the hearing.
    They've also asked for witness statements (including those of the parties themselves) to be included in the documents served.

    Even more worryingly they've asked for me to '..identify each charge about which complaint is made and give [my] reasons why that charge is a penalty/unfair or otherwise unforceable.'

    I'm not sure what this all means or whether I now need to get advice from a solicitor....??

    I wrote to the RBS to claim my charges back on the 16/04/2007 to claim £1919 plus £574.97 interest and got a letter back in a few days to say they were looking into it. Nothing recieved by the 09/05/2007 so sent them another letter threatening court action. Still havent heard anything but cannot afford the court fee at the moment. Any further help would be helpful.:confused:

    the only thing you can do is appeal...I share the same reponse as another poster on here.....where was the news bulletin about your loss?????

  • I work full time and dont have time to be chasing the bank all the time
    I did make a phone call the other day after receiving a letter saying that they weren't going to be paying my charges back ect ect
    Got the number off this forum and the guy i spoke to was very shocked and asked how i got his number(didnt tell him) :rotfl:

    I told him i was going to take it further and he muttered that he would try and sort a settlement figure

    My main question is,is there another number i can ring in an evening to speak to someone that could make an offer or do i have to try and find the time when im working to chase it up

    When i filled in the court questionnaire i said i didnt have witness and expert reports and that i didnt have a solicitor.Just waiting now for a court date of Abbey. Sure u will be able to get help on this website or cag.
