  • Be very carefull. Keep a record of everything including notes when making phone calls. A while back, we used the letter template from MSE and got our statements and used them to work out how much we could claim back. Worked it out, made a claim to the bank, got a repeat set of statements as a reply. Happened twice more with more statements.I asked if they were charging £10 each time but they 'didn't think so'. (I would have liked a definite answer). Made lots of phone calls. Spoke to many people at Lloyds who promised to sort it out each week. Nothing. Phoned and wrote. Last calls promised we could leave it with themand it would be sorted. Next thing was Debt Collectors asking for money as they just passed it over to them instead. Lloyds had told them that there was no dispute. Today tried to get car finance, but got turned down so we got a credit check. LLOYDS HAD PUT IN A DEFAULT last year when we still in correspondence with them. Not Once but TWICE doubling it up. In effect,two defaults and saying we owed twice the amount. No money back and now no credit rating.

    How much was your claim for and how much was the default for ?

    You should write to the DCA saying the account was in dispute at the time they passed it over and you they should not have entered a duplicate default (who are the DCA's?) and to return it to lloyds. Tell lloyds its in dispute and no default should have been recorded and go from there. Can help with letters if you would like but need a bit more info - I assume the debt is an overdraft ?

  • Can anyone tell me if you can re-claim cash machine charges please?

    I sent a template letter to HSBC for list of charges but they only sent overdraft charges. Can I assume you can onll reclaim overdraft charges and no others?

    You cannot reclaim ATM charges. You can claim overlimit charges, unpaid items, and referral fees/gauranteed card payment fees but not the £1.50 or £1.75 charges for using a charging ATM since it is not penalising you for have no money in the ATM to withdraw funds.

    Just wanted to clarify something in the main article, where it says something about July 2007 being the latest date you can claim for. Does this mean I can't reclaim charges incurred since then? This would be a huge pain as that's almost exatly the time that I started to recieve a large amount of charges!

    What it means is the for the argument of limitations act ie 6 years reclaiming, the clock stopped on 27th July 2007 so that means that the bank cannot use the limitations act argument for claims of charges dating back to 27th July 2001 until the OFT test case issues are resolved. so 2001 up to today inclusive CAN be reclaimed.

    Just sent another letter to the Halifax today after they offered me £315, I originally claimed £760. I informed them that I was suffering some financial difficulty :confused:,and since then I have gone into financial management. So I have resubmitted my claim but now I have new charges to add to it, my new claim is for £869.:tongue:

    I was successful with my previous claim and received over £800 for my trouble but had to go through the courts to do so.

    Please tell me you did not reject the offer? Things have changed in reclaiming since the July 2007 so the only offers being made are financial hardship even though the bank does not have to refund even 1p of a claim under financial hardship.

  • Hi all. A bit of advice if I may be so bold?
    Approx 18 months ago I started the reclaiming process against my bank (Nationwide). Now my memory is not great and I do not recall the total amount that was shown on the statements that they sent me after my initial letter and cheque for £10 but I believe it was around £1000. I don't recall how far I got with this and as a result I am not sure if I am in the queue or not. I have recently moved home and as a result my filing is all over the place. Can I write to my bank asking for a status? I do not have a reference number only my personal details and account details?

    Second query is; in the event of a successful payout what are the chances that my bank will either close the account or relinquish my overdraft facility - even though it has not been adused for years?

  • 1) Yes and
    2) they cannot close your account while you are reclaiming since it is a breach of the FSA Waiver on bank charges.
