Reclaim Unfair Bank Charges article discussion Part II

  • hi guys, have just started to do all ofthis, have claimed back ppi successfulyl now and I am at the stage with nationwide where instead of sending me my statements they have sent asll of the bank charges (unauth overdraft fees, unpaid dd fees and interest charges) to me which totals 2120.37 now this is a huge amount to me and will hop[efully buy my gf a lovely engagement ring ifI am susscessful in reclaiming.

    Now, Nationwide have said about the terms and conditions etc etc of my flex account and then they say that they will not look at claims until the test case has been resolved and thatmy complaint wont be looked into until the test case is resolved.

    What do I do now, do I wait until all sorted and then they may refund me depending on what happens or do I need to send them a nother letter to say I want my charges back?

    Am a little confused as what to do now?

    My husband just wrote to halifax and asked if he could have all his charges refunded, he didnt ask for a specific amount as he wasnt exactly sure how much it was. He also requested that his current overdraw charges be cleared but that was ignored.

    Halifax got back to him and offered £370 but they will only pay it in to his account with them, that account is £450 overdrawn, £430 of it is all overdraw charges. He hasnt used that account since last year.

    If you have priority debts arrears of more than the £370, you could try phoning and negociating on that basis, ie the offer won't cover the hardship arrears.

    Otherwise accept the offer and then send them a DPA request and find out the actual amount of charges since July 2001 and then put in a claim for them minus the refund. By accepting their offer, you will not be foregoing the remaining charges.

    Can you confirm you have proposed to your girlfriend?(last thing you want is for her to see it on here before you do the deed ;) ).

    If they have said no then if you are in financial hardship you should have priority debt arrears(mortgage/rent, council tax, utilities). If not then you are in the queue awaiting the OFT test case issues to be resolved.

    I am new to this forum and was wondering if anybody can help me. I have a list of bank charges with Halifax and was thinking of claiming under the hardship rules as I am in an IVA. Would I qualify? Also, my mortgage is with Halifax and I don't want to jeopardise this. Would this be affected does anyone know?

    new to this and i'v found this a useful read and i'm sure all the succesful reclaimers will help me out.

    before the test case i made a claim with Halifax regarding my bank charges unfortunately for me i may have left it too late only to be told that my claim will be kept on file until the results of the test case.

    i then heard about the reclaiming the bank charges on the grounds of hardship, so i sent a letter away to Halifax only to receive a letter in reply that my account has been closed so there's no claim.

    can they do this? I am still receiving letters from Halifax to say there are changes to my accounts every so often, I have stopped using Halifax for a while but doesn't my claim still stand solid?
  • Hi, thankls for your reply. she does not know about the site or is not very computer friendly shall we say so no chance of her finding this, will only propose if can get the ring!

    So I dont need to send the charges back to them ,they have sent me the charges and I dont need to do anything lese, have the processed my claim automatically then and now a case of waiting or do I need to say I want this money back and then wait?

    Providing you have sent them a letter requesting the charges back and have received a response then you are in the queue. If you haven't then you need to do this.

    And I assume you're at work, so get on with some work ;)

    ask the question to Halifax since the mortgage is a separate agreement.
    Furthermore, if you have priority debt arrears(mortgage/ council tax, utilities) then make sure you send a list of charges/ and income and expenditure form(household) and any notices of arrears.

    They can refuse to payout a claim where the account is already closed under financial hardship but the original claim is still valid ie will be dealt with on the conclusion of the OFT test case issues.
    Did you close it or did they?
    have you got an updated list of charges since you first asked the question?
