  • The FOS would agree with that ie that the charges are repaid into the account where the charges have been taken.
    Do you priority debt arrears(mortgage/rent, council tax, utilities)?
    Are any of the arrears being paid off?
    I am looking at the negotiating viewpoint based on your circumstances and how it affects you. How much is the charges in total?


    The charges currently needing to be paid are £450, Halifax are offering to pay approx £370 from charges already paid but towards the £450 opposed to us.

    If they use the £370 towards my £450overdrawn amount (all of which are charges) can my husband then reclaim that as it is still bank charges?

    whilst we are in financial hardship, we arent in arrears with any of our priority debts, besides £80 gas which i cant see is going to make any difference. We are currently in receipt of income support etc and my husband has been for a long time due to disability so should they really of charged him in the first place?

    Yes it was. She is still experiencing hardship but they still said they can't repay her charges again.

    I don;t quite understand this bit. They repay x amount into an overdrawn account so it is still bank charges? How much is the entirety of you claim?

    Why not? there is no legislation that says that the bank cannot put charges on an account where benefits are paid into(I have read the various views that say they can't and the law they quote is not understood that well ;) ).

    Yes, some of it did. But Halifax haven't asked this question. Does it make a difference?

    Sorry, do you mean debt arrears to the bank? If so, the answer is no, all the money she got was hers - there were charges accumulated over about six years so there was no overdarft to pay off at the time she got the charges repaid.

    my husband is been repayed £370, the account they are wanting to pay it in to is currently £450 overdrawn, of which £430approx are bank charges (he hasnt used that account for sometime) and im wondering if once the £370 has been paid in will he then be able to reclaim it as technically its more bank charges that hes paid...

    I'm assuming there are 2 accounts - (a) and (b). The reclaimed £370 is from a/c (a) which they want to pay into a/c (b), which is currently £450 overdrawn (of which £430 is bank charges). Correct?

    If so, he will still be able to claim on a/c (b)
