  • Hi, I am slightly confused. I have an outstanding case with Barclays which I haven't heard anything from them or the court for two years now. I did contact Barclays a little while ago only to be told that they wouldn't discuss it. Without having to read through all the posts, can someone update me as to what the position is with cases that have gone to court please?

    Secondly, can I claim for any charges that I have recieved since Barclays changed their charging policy. I seem to be charged £22.00 even if I go £4 over my limit.

    You need to check your paperwork on the claim since some claims were stayed until the test case ends and some were until a specific date.
    Secondly, can I claim for any charges that I have recieved since Barclays changed their charging policy. I seem to be charged £22.00 even if I go £4 over my limit.
    Barclays reserve useage fees. You can opt out of it. They introduced them in August 2008

  • HI all, i started to reclaim my bank charges from halifax about 18 months ago and i got the usual reply "we have to wait until the test case" etc,
    i have moved house twice since i started to reclaim and have changed address with my bank but do i have to change address with a different dept regarding the charges as i dont have a number etc!!
    any advice would be greatly appreciated.

  • My husband is overdrawn with Halifax, he had originally gone overdrawn by a small amount which then incurred charge after charge. Which he started to pay back at £50pm, but as we're currently in financial difficulty we couldnt meet all our payments.

    My husband wrote to Halifax to reclaim his charges and write off his current overdawn amount which as i said is all charges, they ignored the request to write off the overdrawn amount and he was offered approx £350 which they were only willing to pay into the overdrawn account...what good is that to us??

    My husband then went to the financial ombudsman who has decided they agree with halifax!!! but the woman that has made this decision doesnt understand much and apparently from what she said isnt the financial ombudsman at all and more like a coffee girl from the sound of it!

    I dont know where we go from here....Has anyone had a similar experience? what did they do??

    as far as I know they are within their rights to offer the charges back into the account they were made - otherwise they would be giving you money and the account would still be overdrawn and incurring more charges.

    The FOS would agree with that ie that the charges are repaid into the account where the charges have been taken.
    Do you priority debt arrears(mortgage/rent, council tax, utilities)?
    Are any of the arrears being paid off?
    I am looking at the negotiating viewpoint based on your circumstances and how it affects you. How much is the charges in total?

  • We're on a DMP now, owing £7500 overdraft to NatWest (obviously that account is now suspended and we bank elsewhere entirely.) My question is, given that NatWest only agreed to the CCCS offer, froze interest etc after a lot of wrangling, culminating in a snotty letter that effectively said "Yes, well, alright, but we'll be watching you", how wise would it be of us to try reclaiming the huge amount of charges they imposed in the last 6 years? We don't want to start prodding at a wasps' nest.. besides, how likely are they to co-operate if we ask for a breakdown of charges etc?

  • My partner has recently been charged £25 by Halifax for a unauthorised transaction and a further £36 for exceeding her overdraft limit for a transaction of £12. They have also charged her a further £25 unauthorised transaction fee for another transaction of £20. So for two transactions totalling £32 they are going to charge her £86!!

    When we telephoned Halifax to see if we could reclaim the charges we were told that as they had already paid her back nearly £800 in charges earlier this year they can't pay back any further charges incurred on her account. They stated that this was the policy of all banks.

    Has anyone else had this experience with Haifax, or any other bank?
