  • Hi can anyone tell me what mcol is and how I use it? I have an account with Natwest and they have taken hundreds over the years from bank charges. I would like to try and reclaim these but am not sure where to start

    Hi guys,
I have just received statements for my friend for their business bank acct. Whopping amount of charges with HBOS. I cant remember if I asked this but are they on hold or do they proceed like credit cards and have no hold. Cheers! Also are the letters just the same!

Do you have the details of the charges that you want to reclaim?

Business account claims are really difficult because you cannot rely on UTCCR 1999 which is what you would rely on in personal accounts. Furthermore, you have to get around the read over from the OFT test case so you will need to study the OFT Judgements and the terms and compare them with the business ones to be able to make a case which I believe is using UCTA 1977

Thanks for that. I was also wondering there seems to be hefty charges for cash lodgements ie over 200 a time. When going ahead with this reclaim can I put these it. They seem so extreme. I understand there are charges for the service and worked for RBS myself so I realise you are paying for certain services but I dont recall them being so high. Cheers!

The answer is that it is a NO on charges for cash lodgements.

If you haven't exceeded the account overdraft then it is not reclaimable. However, I would check with the bank as to whether you have an account with benefits because you aren't using them and I would downgrade the account to one without benefits.
