    Then once the House Of Lords has issued a verdict, if it doesn`t fall in favour with the banks then the next step will be for them to take it to the European Court. Again if the banks lose out here then they shall no doubt take it to the European Court Of Appeals.

    After that I`m fully expecting everyone to have their charges reimbursed by 2037

    I never thought to add that bit - hopefully the people concerned will still be around to enjoy their windfall, assuming it goes our way, by 2037!!!!!!!!

    I was just wondering if anybody knows if I would be able to claim the Reserve Usage fee of £22 back from Barclays everytime i go over my overdraft that I'm currently paying? Will this be treated in the same way as a 'normal' bank charge for an unauthorised overdraft?

    £12 is credit card charges and it not subject to the OFT test case. They're claimable.

    The house of Lords would have to refer it to the ECJ so that is unlikely as the ECJ is more consumer friendly.

    yes you can and I would ask Barclays to remove the personal reserve from your account.

    Natweststaffmember or any one who can help.

    Ive successfully reclaimed from Capital One before but I have got more after this charges which I would like to reclaim.

    I sent off the 1st letter asking for the money back but they got back to me saying that because default sums have been settled through a previous claim that they will not allow it.

    1.Capital One Master Card is a credit card isnt it? which means I can still go ahead & send the 2nd letter? Is it the one where it says that because its credit card charges & not bank charges that I would like my complaint reinstated immediately as it is not covered by either of theses arrangements? Is that the one? :confused:

    2.Can I still claim £12 charges? :confused:

    3.Can I still claim if the amount owed is now with Debitas Legal Services? :confused:

    Since the above post Debitas have now sent me a letter that they are planning on or selling my account to an external Debt Collection Agency.

    Whats annoying me is that they say I owe £298.15.But £192 of this are charges so really I only owe £106.15.But I cant owe this as Im out of work not through redundency.

    What should I do with all of the above?
  • Remind them that charges up to x date were settled and that further charges were levied to the account which means they have to repay.

    Do I need to contact Debitas to ask them to put it on hold?

    Tell debitas that you will deal with Capital One for now as a dispute has arisen over the amount of the debt owing. And YES to the £12

  • Hi Guys,

    I have a question about what to do when trying to reclaim charges if you dont have a chequebook.

    I am about to send off my letter requesting:

    " a fully comprehensive list of all the default charges for account, cheques, card, late payment, direct debit, authorised and unauthorised overdrafts and standing orders I have paid since 27 July 2001 and any other charges since this date."

    But i cant pay via cheque. I have funds in the aco!!!!, but i do not want to say "just take the £10 from my account incase they play silly !!!!!!s and charge me multiple times - to the point where i'm in my overdraft and they charge me again (but didnt inform me at the time)... (Lloyds have done me over multiple times and told me lies - bad customer service - possibly the only reason i'm claiming at all).

    Is there another way to send them this charge?
