  • what is the correct address? I got this one from forums but now looking at the site more indepth it is only for court claims that go here! So, I should have sent my claim recorded to the branch then... What a bummer. If my claim is for charges in the period dated from 1st aug 2002 to 2 oct 2003. Can I still claim and do you think they will accept a new letter (recorded delivery of course)

  • I appreciate the objective of this campaign but in essence it is repaying those who have broken a contract with their bank. If you draw down funds or pay a direct debit or present a cheque that puts your account into overdraft or exceeds an agreed overdraft limit you have broken your current account agreement with your bank. No "IFs and No Buts". Accordingly they are entitled under the terms of the contract to require you to pay them for the call on some other clients funds to meet your breach and remedy the offence. However, the term "unfair" does not refer to the charge but the amount of the charge. My view therefore is that the banks will lose their case in principle but will be permitted to make a "fair" charge that is much higher than people think. Don't get too excited.

    After the latest crisis they could go back to the 1950s or earlier when if you went overdrawn it was an offence in law and REFUSE to meet ALL unapproved overdrawn situations. Then creditworthiness would really mean something.
  • Hi im hoping someone can help me. I sucessfully claimed back my charges approx 2 years ago and received just short of £1600.00! However I was made redundant 4 times since then and I have incurred more charges. Does anyone know if it is possible to claim again for the charges I have had since my previous claim? Thanks

    Edinburoughlass or any one who can help.

    Ive successfully reclaimed from Capital One before but I have got more after this charges which I would like to reclaim.

    I sent off the 1st letter asking for the money back but they got back to me saying that because default sums have been settled through a previous claim that they will not allow it.

    1.Capital One Master Card is a credit card isnt it? which means I can still go ahead & send the 2nd letter? The only thing is I cant find the template letter saying this :confused:

    2.Can I still claim £12 charges? :confused:

    3.Can I still claim if the amount owed is now with Debitas Legal Services? :confused:

    Since the above post Debitas have now sent me a letter that they are planning on or selling my account to an external Debt Collection Agency.

    Whats annoying me is that they say I owe £298.15.But £192 of this are charges so really I only owe £106.15.But I cant owe this as Im out of work not through redundency.

    What should I do with all of the above?

    Hi, Ive just recently claimed £260 of charges from Capital one/Mastercard
    I used a company called portal claims and they got it back for me really quick, much easier than dealing with it myself, as the kept ignoring my letters.. Although the company take a percentage off of you they are really quick at getting it back..

    From what I can understand it's going to take at least a week for this case to end but it could be the end of October before we get an actual decision!

    Then once the House Of Lords has issued a verdict, if it doesn`t fall in favour with the banks then the next step will be for them to take it to the European Court. Again if the banks lose out here then they shall no doubt take it to the European Court Of Appeals.

    After that I`m fully expecting everyone to have their charges reimbursed by 2037
