    Hi Guys,

    I have a question about what to do when trying to reclaim charges if you dont have a chequebook.

    I am about to send off my letter requesting:

    " a fully comprehensive list of all the default charges for account, cheques, card, late payment, direct debit, authorised and unauthorised overdrafts and standing orders I have paid since 27 July 2001 and any other charges since this date."

    But i cant pay via cheque. I have funds in the aco!!!!, but i do not want to say "just take the £10 from my account incase they play silly !!!!!!s and charge me multiple times - to the point where i'm in my overdraft and they charge me again (but didnt inform me at the time)... (Lloyds have done me over multiple times and told me lies - bad customer service - possibly the only reason i'm claiming at all).

    Is there another way to send them this charge?


    Yes you can either pay this £10 charge by postal order or even go to the bank and ask for a bankers draft payable to XXXXX for the £10. (They may however make a small charge for this though)

    Better still, do you have any friends or family that you can give the £10 cash to and they in turn give you a cheque payable to your bank.

    I'm assuming the postal order doesnt need to be addressed to anyone.

    Or should i just use the name/address of the bank's data protection office?

    (on a side note: how far back can we go with the cc charges?(not related to my earlier post) has that changed? ..dont want to hijack this thread so i put it in as a footnote :) thanks again).

    The PO will be made payable to your bank by the Post Office staff. Send the PO recorded delivery to the bank.

    It doesnt really matter which office you send the first letter, as the banks internal mail system will ensure it gets to the right place. Dont forgot you got a recorded delivery proving it was sent to them.

    When they start communicating with you, you will then have an address to send the next letters.

    I have answered your CC query on your other thread, but in short I believe it to be 6 years back.

    I think the problem with threads this long going over a long time period is that its an awful lot of reading to find answers and things change all the time. So thanks for taking the time to answer these questions.

    So will we ever get to the end of this process????

    Everytime we get some where it gets put back further and further! October now until we get the house ruling and then where? Also why did the the OFT take on this case if it didnt deem the these charges as unfair??? Its becoming infuriating!

    We are 4 years in and still have no light at the end of the tunnel!!

    Also why did the the OFT take on this case if it didnt deem the these charges as unfair??? The issues were firstly (a) were they penalties in law or (b) were they assessable for fairness under UTCCR 1999. It is (b).
    Its becoming infuriating!

  • I wonder if someone can advise me, I reclaimed against HSBC two years ago and won, however, I still never got myself on track and is starting another claim today against them for nearly £3500.00. I have use the hardship letter. I really don't know what will happen now after I sent the letter today. Is it wise claiming from the bank again. :confused:
