    I'm trying with First Direct (part of HSBC) and I think they're one the harder ones - there doesn't appear to be many success stories.

    They acknowledged that I was in financial difficulty (don't know if there is a subtle difference between difficulty and hardship) but didn't consider that their charges were the cause of my problems and stood by the fact they still consider their charges fair and reasonable.

    I would personally love to hear from any First Direct claimants to share experiences.

    What do you mean? Is this a credit card complaint? or bank charges?

  • So I totalled up my charges back in 2007 and sent my letter to Barclays asking for my £2600 back and they replied with a letter about the test case and that I had to wait until the outcome and the decision had been made before they would make payment. Since that point I have had probably about another £600 of charges applied to my account becuase of losing my job (Got a new one now thanks!)

    If the decision goes bank customers way and we get our money back can I make an addtional claim for the other £600 or will Barclays automatically take that into account and refund that as well??

    You can claim for addtional charges should the bank lose the OFT test case

    Personal or business account? And definitely ask them why you have been charged this amount.

    There are worse banks unfortunately.
    This second letter was just re-itterating the hardship case, so we'll see if that gets them moving. Could really do with that money!

    Firstly, thanks to everyone posting some fantastic advise here! Which I need a bit of now...

    On 20th March 09 I sent off a claim to Alliance & Leicester under Hardship (unemployed with priority debts). Recieved the I&E form within a couple of days which I returned completed the same day.

    Where I need advice is this - since then I have been offered a full time job (Woo Hoo!!!) and I start today!

    Do I need to inform A&L? There was nothing on the letter they sent telling me to inform them of change of circumstances so should I allow them to process as is?

    No you don;t at the moment. If they do offer a refund then some of your priority debts can be paid.

  • I am just wondering where the fairness is. Banks get a waiver for the Bank charges and hold our money back, but on the other hand, the customers have to keep paying the charges. I just had 3 Charges of 35 pound each for 3 not paid direct debts. The funny thing is, that each of those direct debits was only about 10 pound and the money to cover them was in the account today. The bank can see there is the same amount of money coming in each week and they knew it was enough to cover the dd's. Just one day was in between the day the dd's should have been paid and the day my money came in.
    Why does the Ombudsman not do anything about that?

    Can you not move the DD's by a couple of days so the money is in the bank first that way you are not getting charged?! It is not hard to change the date on which a direct debit is paid!
