That is the thing. I have been trying really, really hard to avoid the charges but it is difficult when oyu are on an extrenely tight budget; and very often one charge draws in its wake several more charges that would not have occurred causing a downward spiral that you just can't stop; it's like a black hole.
It really is not helpful when others who obviously are not living on a financial edge just stand there and criticize. The thing is, the banks are happy with the situation as is. If there is not enough money to cover a direct debit I don't see why it is not simply refused, the way my card declines to pay the supermarket when I don't have enough funds.0 -
I'm after a little help, nearly a year ago I sent a letter to the head office of the RBS in Scotland as I used to have 4/5 accounts with them unfortunately I closed them all 2 years ago, I got a letter back saying that if I don't have a sort code and account numbers there is nothing they can do.
A few weeks later and I went into my local branch and as I approached the desk the lady recoignised me and said hello, now the strange part although she remembered me and gave me my sort code they had no details of any of my bank accounts, I was passed on to area controlled which searched the system for a month or so and also said there was no sign of any of my accounts.
Does anybody know where I can go from here please0 -
Some Advice Please - I started my bank charges reclaim from the Alliance & Leicester in April 07, sent all of the letter using the templates on this Website (really helpful thank you). The last letter I sent said that I would take the bank to court. Then the freeze happened and I have done nothing since. Do I need to restart my claim for approx £7500 including interest or can I go straight to the FOS and try to reclaim my charges through them. Really not sure where I stand at the moment.
Hope to hear from someone soon0 -
Send A&L another letter with updated figures on your claim. You will likely be put on hold pending the test case outcome unless you are in financial hardship. FOS would also put you on hold.LegalBeagles0

Send off a subject access request and £10 fee under the data protection act with details of your full name/past names and current / past addresses. Under the DPA they have to provide all information held about you as an individual not as an account number so that should show anything up.LegalBeagles0 -

I reclaimed my bank charges in 2007, didn't get it all back, but i was happy with the outcome.
Since then, they have stripped me of my visa card and given me a solo debit card instead. Im not really bothered about that, but since i reclaimed my charges, they charge me for the smallest amount, the smallest amount i went overdrawn was 23p, i was charged £28 for that, which took me to -£28.23, now beacuse i was overdrawn by that much, i was charged another £35 at the end of the month.
what really gets my goat was, that when the £35.00 was charged to my account, i was then left with -£4.00, which i then incurred another £28.00 charges.
It seems to be ongoing, and i can't win.
Since i made my claim, i have become a single parent and disabled due to a degenerative disease, they know im on benefits, as ive phoned them a few times in tears as my benefit money has been swallowed up by charges, they really don't give a dam.
I know i can't claim my charges back again, as i had to sign a disclaimer when i claimed the last lot, im just at my wits end on what to do for the best, i really try hard, but its getting beyond a joke now, for silly little amounts"
sadie you got you money back back in 07, GOOD ON YOU!. it was your money in the first place.
I do believe you latest charges you can still claim back. When you signed last time, it was for your older charges. Your new charges are not affected by this.
Down load the template letter and send it off. Even if it goes on hold, you will be able to claim the money back.

It may be the change of account has removed any buffer you previously had on the account. If you are solely on benefits then you may want to consider having a Post Office Card account and pay things in cash/paypoint, if you are able to visit the post offce weekly, else move to another banks basic account to break the circle.
Yes you can claim back these current charges, and all those between your last refund and now. Also you may come under financial hardship criteria so could get your claim processed despite the waiver.
ALSO - do the bank give you advance notice of the fees ? not sure which bank you are with. Have a google on 'first right of appropriation' or search on here, you can ask them, 7 days in advance, to let you have your money for essential living costs rather than swiping it out in charges.LegalBeagles0 -

I am sorry if I am being thick but by updated figures do you mean restart my figures from now or can I still use the figures plus extra interest that I used in 2007.0
