Reclaim Unfair Bank Charges article discussion Part II

I am currently in a DMP and have sent in letters to HSBC and Abbey to reclaim my bank charges, which, (including interest) amounts to £4,000.
I have received the standard response letter "we believe charges are fair, everything is on hold, blah blah blah" etc
It says in the notes on this site that an FSA Waiver is in force that should mean that cases of financial hardship should not apply to the current situation and that banks should settle these cases. As I am in a DMP, I would think I count as being in "financial hardship".
3 Questions
1. What do I do now? Do I write back, insisting that they settle the claim
2. Will this make the banks get nasty on the DMP and try to call in the entire loan / take me to court etc
3. I have over £3,000 Business bank charges I want to reclaim, and the business is in financial trouble. Can I reclaim those as well?
ANy help would be greatly appreciated

Started my claim with Halifax for unfair charges in May 2007, after numerous letters i was then put on hold due to the ongoing court case. On Martins advice i telephoned today to register for financial hardship. I have been informed that letters will be sent within 5 days and i will then be assessed. They also informed me that due to web sites like this they have now increased their limits (ie no longer if you have charges over 500 pounds during the last year are you in financial hardship!!!) they refused to provide me with the new amount. Once again the goal posts have been moved by the bank, im still broke and still being charged constantly when will it ever end???:mad:

hi everyone , before i start i should say this is my first post on here..
anyway, i have just had a response from HSBC regarding my reclaiming of bank charges for the last 6 years,they have basicly told me i need to prove im in financial hardship and have sent me an income expenditure form to fill out, even though i have been recommended to their debt management team and have incurred over 500 pounds of charges in the last 12 months.
can anyone point me in the best direction now? should i fill in the expenditure form and send it back with a letter requesting it proceeds under hardship ruling or should i take it straight to the ombudsman?
sorry if this has been answered elsewhere but im at a loss as to the best route to pursue going forward..

hi guys first time on the thread
i have just been looking over the overdraft charges that i have incurred over the last few years but am unsure what i can claim for.
i have been charged £35 per each direct debit that was sent back unpaid
and also unplanned overdraft excess fees.

FOR THOSE CONSIDERING CLAIMS BASED ON HARDSHIP:
This is a link i found on the thread regarding claims based on the hardship rules, for a template letter.
It seems there is a long wait even for these type of claims. I also believe that banks are still not obliged to refund you, but can offer to cease adding further charges.
If you exhaust the process with the bank and are not happy, then send your complaint to FOS.One step at a time0 -
Hi can anyone help, applied for a refund on the charges I received on my current account. I received the usual letter re; the fees being fair after a couple of letters still no joy, at the time I was struggling financially in the respect the fees were just making a snowball effect of charges and couldn't see a way out financially, the bank wrote back and still deemed I was not in financial difficulty. I threatened court action but still nothing. I haven't done anything now for a few months. If the court deems that the bank charges are unfair does this mean I will automatically get my charges back or do I have to act further??0

I have been trying to reclaim 4K for 2 years and have sent off all the letters, I have ended up with some debt and now have mortgage arrears, i have contact halifax again last week with copies of letters, court appts etc and they have now sent me the copies back but the letter has a Solveit number on it now, do you think they are about to settle???? Just had my first ever overdraft fee from Nationwide. I went overdrawn by £200 and it was in credit the next day due to a cheque clearing. For this I have been charged £20 plus 36p interest. Im not at all happy, whats the best way to deal with this? Send the template or talk to them first? Or am I not even entitled to it?0 -
Hi has anyone tried with the woolwich? i'm about to send the letter asking for statements, Baarclays sad they would send them when i called a while back but never did??0
