Just had a letter from HSBC advising i went overdrawn twice in the last month. once for 5 days and the other for 1 day, which i rectified. I've been charged £50 for this. I was on the phone to HSBC asking why this happened and said that the charge didnt justify what happened because i had no prior warning and no correspondance. I have all statements online. Do you think I'll be able to reclaim my bank charges.
went into the bank and soooorted :rotfl::rotfl::j:j0 -
Hello,
I claimed money from the Halifax a few months ago which they duly put into my account after I had taken them court. I thought I had cancelled the mcol (obviously not), but have recently received a letter stating that my court date will be on 12th September.
Since then, Halifax have charged me a further £101 in charges. I have sent the two letters and am now ready to go through the mcol again process. My question is......
Is it wrong for me use this court date for an old claim but with my new £101 charges?
Any help, greatly appreciated.0 -
You would need to pay £35 to change your claim amount.0

We had our case moved from Northampton to Nottinghamshire. We have put in our evidence and were at the end/middle of the period for Lloyds to submit theirs respectively. Last week my partner had a letter from Lloyds Solicitors explaining they were going to apply to the Court for a stay. (Incidentally although my case is a couple of weeks ahead I had nothing!). The next day we then had a letter each from the Court explaining they were staying both cases! This was well before the Aug 13th date too! What we can't understand is;-
1.how we can have a stay so late in the day when its only at the court descreation.
2.Why we have to pay £65 to object to this (which we do strongly)
3.What choice we really do have - none it would appear!
Is anyone else in this position?
hi yes I had a directions hearing set up 14th August and on friday 10th letter from court saying the case was stayed, but not only me BETWEEN 5 TO 600 OF US ALL SET FOR 10.30 THE SAME DAY. THE BANKS HAD NOT EVEN APPLIED AT ALL WHEN THEY SHOULD ACTUALLY APPLY EACH CASE SEPARATELY WITH A £65. CHEQUE ATTACHED TO EACH. So when we sent in our aplications for the stay to be set aside the fee was waived. have a look on the CAG site on Cardiff directions hearings *POST HERE* some very good templates for objection letters we sent to the MOR, MPs, National Assembly for Wales etc.0 -
Hi i am new to posting on this site, although i do read the forums regular... i'm confused, since the oft's ruleing on the 27th july are people still recliaming??
i was recliaming from halifax, natwest and hsbc, but since the 27th i have stopped, i sent off first letters to natwest & hsbc, but sent second to halifax as i got the usual refusal from the first letter sent.. I have had the standard letters from all off them saying that for the time being everything is on 'hold'!!!! but i was wondering are people still pushing or is it because they have had their court date's,,, sorry for sounding dumb!!!!

I am claiming my bank charges from Lloyds TSB via the courts, I have had a letter back from the court refering to the OFT test case and that Lloyds are filing a defence or holding defence and that any party affected by this order may under rule 3.3 (5) apply to have it set aside, varied or stayed. such a party must apply under rule 23.3 within 14 days of the service order. what does this mean? many thanks D Price.0 -
Can someone help me?
I have sent off my letter to reclaim my Credit card charges and HSBC have said due to the recent OFT announcment i am basically not able to do so etc.
But i thought this was for bank charges not credit cards? Are they having me on?*PROUD TO BE DEALING WITH MY DEBTS!*0 -
Help please, not sure what to do now. Had a letter from bank saying they will pay 'Good Will' payment into my bank account, which they did. Sent them a letter which they received on the 9th Aug saying I will not accept this in full and final settlement. Also faxed it through on the 17th Aug, still not heard anything from them. Should I telephone or should I send another letter saying that I still do not accept in full and final settlement and that as stated on the fsa's website they have no right and that thank for part payment and that once the test case is sorted will be fighting for the rest?

Hi All
I posted a question on page 137 but nobody has answered so i'm trying again. Having claimed for my bank charges from Halifax and won them back i am trying for credit card charges.Halifax sent me a letter saying that no more applications for charges were been looked at until the test case has passed. Am i right in thinking that this only applies to bank accounts and not credit cards, any feedback is greatfully received.
Thanks Sparky0
