    I think it worked in my favour as Lloyds had not complied at all with the Judges orders all through the case when requested to do so. So this was my main objection to opposing the Stay when requested. I also spoke about how long the case had been going on and LLoyds have had plenty of time to settle prior to it going to court.
    So the Judge refused the Stay due to these points and also as it was for a modest amount of money. He also pointed out to Lloyds solicitor that I had submitted an "immaculate" bundle (his words not mine) and that they had not submitted any evidence to back up their case at all. He also named a few other points but as he had already refused the stay by then my mind was in a whirl.
    To be honest the solicitor was a nice guy and congratulated me on a good win when we got outside.

    You must press this with the court concerned. They admit they had the bundle so it is their responsibility to find it.

    I just cant beleive this situation is getting to this stage!! I too delivered my court bundle by hand, and (fortunately) insisted on a receipt, the lady said they dont usually give receipts, but kindly date stamped a comp slip and wrote received bundle dated ..... 100 pages and wrote the case number on it!!

    Thank you for your post, i am sure it will encourage people to ask for receipts from now on!

    Ozz, I think you should complain to the court....you have been treated really badly because when the banks dont get their defence in in time, they just get let off, and asked to send it later.....

    Good luck with this. Dont give up....

    Thanks for the support guys. I am printing off to take home to show hubby (R); he was so gutted last night he turned to :beer: ! Really could do with some advice what to do about taking on Barclays now. We don't know if that's it - finished and they have won. I wonder if the court will write to him confirming their decision. We can't give up, and won't. He is £220 down the pan. I cannot tell you the difference in my life since I have had my funds returned from Barclays - £4,500. I no longer have an overdraft, can draw money out of the hole in the wall, and am getting no charges! We all must keep on.

  • Hi i wonder if anyone could give me some help or advice.

    I originally wrote to lloydstsb on 4 April with the letter to reclaim £500 worth of bank charges.

    They wrote back saying charges were lawful etc 6 weeks later. I havent done anything further as I have a very busy life - i am a student midwife and had essays exams etc at that time as well as 2 kids to look after.

    I am in financial difficulty now, rising mortgage costs, rising credit cards bills as only receive a bursary from NHS. Can I proceed further with the claim now I realise it would have been better for me to reply straightaway but my exams etc had to take priority.

  • Both my partner and I put a claim via the Moneyclaim website in May 2007. Both these claims amounted to over £7,000 together. We had our case moved from Northampton to Nottinghamshire. We have put in our evidence and were at the end/middle of the period for Lloyds to submit theirs respectively. Last week my partner had a letter from Lloyds Solicitors explaining they were going to apply to the Court for a stay. (Incidentally although my case is a couple of weeks ahead I had nothing!). The next day we then had a letter each from the Court explaining they were staying both cases! This was well before the Aug 13th date too! What we can't understand is;-

    1.how we can have a stay so late in the day when its only at the court descreation.
    2.Why we have to pay £65 to object to this (which we do strongly)
    3.What choice we really do have - none it would appear!

    Is anyone else in this position?:mad: :mad:

    I wonder if anyone can help!

    I've just flicted through this website to see where Alliance & Leicester sit in all this...I sent my claim letter and received a letter back on the 27th July stating that their charges are fair and won't be offering me a settlement, but can continue with their own compliant procedures if i wasn't happy...in other words,fogging me off!!

    I'm not sure where to go from here - has anyone been in this same position?
