Reclaim Unfair Bank Charges article discussion Part II

My claim whilst only a modest small is baffling me at the minute, today I received a letter from the local court to where it was transferred to asking me to file them and service the BS with 1]the dates with evidence, 2] what charges are being sought and 3] the reason why I want them back....but they already have this information when I first filed the claim....so what their game...?????????
Hey, its quite standard for them to ask for this info again - just send them a list of the charges you are claiming. How did you file your claim - MCOL ? or at the local court ?LegalBeagles0 -
Does anyone know if you can claim, then claim again?
I claimed back my bank charges which totalled £215, after just one letter my bank (HSBC) sent me a response which basically said they wernt doing anything wrong by charging me blah blah if it wer to go to court they would win blah blah HOWEVER as a gesture of good will we are offering you £205!! :rolleyes: Just sign this letter and it will be put in your bank.
So obviously I signed and got the money
A few months later and I have now racked up roughly £500 worth of charges due to an overdraft THEY decided to give me then charge me silly amounts for!
I cant remember what it said exactly in the letter as I now cant find it :rolleyes: but its possible I agreed to not make future claims ..... though cant actually recall reading this.
Should I try claming again? Do I have any right to if I signed a letter saying I wouldnt claim again? What could possible happen?
Any advice greatly appreciated as these £125 charges are crippling me!0 -

Quite simply yes you can claim.....im on my second claim from my current bank.

It did all start at the MCOL but they transferred it to a court in the next town but I was not made aware of any such court date there....

Send in the info the court have asked for - to the court referenceing your claim number - and copy it to the defendants. A list of charges, with dates and reasons will suffice with a covering letter explaining what it is for.LegalBeagles0 -
Has anyone out there had probs trying to get copy bank statements from above bank aka Royal Bank of Scotland - I been waiting more than four month - surely this ain't rite??:mad: :mad:0

Hi there, can anyone help me please.
I applied for my bank charges to be repaid by the Halifax and followed Martins template to the letter.
I filed my claim and gave them the 28 days they are allowed to acknowledge/defend the claim. When they didn't reply I asked for Judgement by default which I was granted on the 1st August. I then wrote to Halifax and told them to pay up and they ignored those letters too. I managed tp get a hold of their legal teams number and called them. They said that even though I had won the case and they haven't contested it I won't get a penny until the Test Case/Whitewash is done. I threatened to get the bailiffs in and the girl laughed at me and said they would apply for a stay against any warrant. The cheeky little so and so laughed again and said you ain't getting nothing and hung up.
Do I have any leg to stand on with regards to having a warrant executed?
As my claim started before the test case was announced but judgement was after the announcement does this mean I am stuffed.
Surely as I have won through the courts and have acted properly throughout I should be entitled to the claim. The Halifax haven't responded to any letter I have sent them for the past 3 months, or even acknowledged the court claim and yet it seems that they are the ones who are going to win.
Please someone help me before I lose my temper and move to Kazahkstan!!0 -

The banks are digging an even deeper hole for themselves including Halifax.
Rudeness seems to be the card they play now.
When the OFT announced this court case, it was said that claimes prior to that date would go through. If your judgement was before that date, you have every every right to apply for a warrant of execution.
Ask the court about this.
You may also care to write to the Chairman of the Halifax complaining about the rudeness of his staff .... he will not like that.
Ask the Chairman for your money and go over the heads of the plebs you spoke to.The Winner Takes it All0 -
