  • Please can someone advise me?

    I'm in debt and have several debts on credit cards which are costing me apprx £6/700 per month (although on 0% and life of balance offers, minimum payments are high). Therefore, I really need my money back from the banks asap and can't afford to wait til next year!!!

    Although I did successfully claim back my bank charges from one of my Halifax bank accounts before the stay was announced I now wish to claim for another Halifax current account, two visa accounts and a Nationwide current account.

    Can I do this under the claim of financial hardship and, if so, what would be the best way to go about it?

    I would really, really appreciate any advice offered.

  • Can any one help me please I started court proceedings with Clydesdale and I have an acknowlagment but it has come back renamed to barclays bank plc. Is clydesdale owned by barclays or have i made a monumental clanger.

    yes but getting the banks to understand that in cases of hardship they must continuie is another matter!!!!!!!!!!! HSBC point blank refuse. and F Ombudsman 'currently dealing with an unprecidented level of queries'. They obviouslyt havent even read my complaint forms as their email to me(after i had to chase up what was happening with my complaint), said at the end if your complaint is about bank charges and goes on about the ruling, which is exactly what the bank are saying as well!
    Im am thoroughly fed up with all of this, i desperately need this money and need it now, but the downward spiral these charges have got me into is just increasing, i have been so desperate i have even tried to get a loan!!! But because i am on benefits i have been turned down.
    Does anyone have an address of some top bod at HSBC who it might be worth writing to to explain my dire situation. Ive lost faith in the ombudsman to be honest. has anyone had any luck with them chasing the banks under the hardship rules??

    I had originally emailed the FSA who phoned me back and told me that the bank were in the wrong and to go to the ombudsman, should i now go back to the FSA and explain that the ombudsman are doing nothing at the moment and i need the money.
    Any suggestions on how i can hurry this along would be most welcome.

I recently requested £400 in over charge fees which consisted of £20 and £12 charges, and they sent a letter back saying they would refund the difference between the £20 and £12 but they all stood at £12 and this is a fixed fee. Can i continue and try for the £12 charges back or is that my lot? Also on my Halifax One all the charges are for £12 but they charge for over limit and late payment so its £24 per month, what are my chances?

    I won with cap one and got back ALL charges you do have to take them to court to get it back but they pay up in full befor court date so you dont have to go to court.
    I dont know about Halifax but good luck with cap one dont give up its your money go get it . they paid me the diff between the 12 and 24 but i wrote back and said i will take it as part payment without prejudice but will continue to court for the rest . Thats what i did and it worked so good luck

    am claiming back charges from a & l for the amount of just over £1,000 which has been applied in charges since June (10 weeks). Had an offer but refused it, then because of the court case they wrote and told me my complaint wouldn't be considered until after the court case. I then received a letter requesting back the £1,000 and i wrote and offered them £40.00 a month.

    I have today received a letter saying that before my offer can be considered they are obliged under the Consumer Credit Act to issue me with a DEFAULT NOTICE !!!!! (This is the 1st i've ever had and its freaked me out.....)

    The DEFAULT NOTICE says that I must pay £546.01 by 12th September or further action will be taken which can include

    * Serve notice in writing demanding the immediate repayment of the total overdrawn balance of your account. If nothing is received, we shall bring proceedings against you for the total overdrawn balance of the account.

    * Withdraw banking facilities from you

    They say they are going to write to me again in 7 days when the period given in the DEFAULT NOTICE has expired.

    Please can someone give me some advice on what to do? I am paying abbey £40.00 a month and never had a problem with them.

    I have gone through most of the process letters, money claim online and have a court date with HSBC. Unfortunatly I am on Holiday at the time of the hearing and will not be able to attend court. What action do I heed to take. Also they have applied to the court for a stay but as yet i havn't heard from the court.

    You will need to pay for a warrant to be issued (cost is £55) and you can do this from the moneyClaim online site if that is where you started your claim from.
    It's up to you whether you have the bailiffs warrant issued to the Banks head Office OR your local branch - I s'pose whatever you think will be more effective.
    The warrant will be sent to the bailiffs office at the local court to the address you quoted and the bailiffs will visit over a course of time in an effort to recover your money.
    We are in the smae situation with Lloyds and have still not received a penny - so don't hold out that it's going to be a quick and pain free process even though you HAVE won judgement and even though you DO issue a warrant.
    We have let Lloyds know both of these fact - and they seem to aloof to care and in my opinion seem to be laughing in the face of the court decision.
    i in fact feel quite distressed about the lack of progress and am beginning to think that the court process is a little ineffectual in fact.
    Anywhow - I don't think that your bank can ask for a stay now, especially as they did not meet the judges requirments and did NOT attend your hearing of yesterday. In other words they had every opportunity to attend yesterday and request a stay - but chose not too. So write telling them to pay you by the end of the week and threaten a bailiffs warrant, and WHEN you don't receive payment from them, make sure that you then issue the warrant as it is the only way forward for you now.

    Can anyone advise me please as I've been trying to obtain bank statements from Lloyds TSB without success. They have now contacted me to say I have to pay £10 for each year I want. Is this correct?
