I received a settlement letter from Barclays 11 weeks ago and promptly faxed it to them saying I accept. This was 2 days before my court date so I didnt go and told the court I had received a settlement letter so wouldnt be going. I have yet to receive the money and I have emailed the lit team who are just ignoring me. The last email I sent was last Monday to say they had a week to pay me the money or I will take them to court for breach of contract. Needless to say I havent received the money or heard from them. I have read that you can get the bailiffs involved but can someone please advise me on what my next step should be? Thanks!:mad:0

Hi All,
Could someboody please gie me some advice regarding the FSA. My husband has a claim in with LTSB and he has recently been given a court date of 8th November for his case to be heard, when he rang the court to query this he was informed that his claim was definately going ahead on this date. Are they allowed to do this ??

Bank Barclay's, amount £412. I went to court on 5th September, whilst in the waiting room Barclay's barrister told me he would be requesting a 'stay'. The judge allowed this pending the outcome of the high court case. He also said he didn't know what the banks were doing as only that morning two cases had been resolved without the case being heard, and that they were 'substantially' higher than my claim
. He did allow me expenses though of £5.50. Won't spend it all in the one shop :rolleyes:. 0 -

I received a letter from my bank (HSBC) stating that they would refund my bank charges so I sent of the letter of acceptance. This was approx 2 weeks ago and no money has been put in my account. I rang them today and they received my letter but informed me I must fill in another letter of acceptance. I did receive the other letter but did not send it off as i just thought it was another reminder about the previous one. When I spoke to them they assured me i would receive my money if i send of this new letter which informs me about the legal proceesings that have been going off recently etc etc. I'm a bit dubious about this though will i still receive my money?0

It's up to you whether you have the bailiffs warrant issued to the Banks head Office OR your local branch - I s'pose whatever you think will be more effective.
The warrant will be sent to the bailiffs office at the local court to the address you quoted and the bailiffs will visit over a course of time in an effort to recover your money.
We are in the smae situation with Lloyds and have still not received a penny - so don't hold out that it's going to be a quick and pain free process even though you HAVE won judgement and even though you DO issue a warrant.
We have let Lloyds know both of these fact - and they seem to aloof to care and in my opinion seem to be laughing in the face of the court decision.
i in fact feel quite distressed about the lack of progress and am beginning to think that the court process is a little ineffectual in fact.
Anywhow - I don't think that your bank can ask for a stay now, especially as they did not meet the judges requirments and did NOT attend your hearing of yesterday. In other words they had every opportunity to attend yesterday and request a stay - but chose not too. So write telling them to pay you by the end of the week and threaten a bailiffs warrant, and WHEN you don't receive payment from them, make sure that you then issue the warrant as it is the only way forward for you now.
Thanks ronnie- i hope you get yours sorted soon i rang the courts today and was told that i have to wait 28 days to get an warrant of execution did your court give you any guide to how long you would have to wait for the baliff to recover the money?0
