Hi there,
I tried ringing Halifax after they sent the second letter saying everything was lawful and now due to the case everything was on hold - I said I was aware of the case but not happy with the result and that I wanted my particular case referring. Halifax told me that no-one could get their cases reviewed now and that it wasn't them enforcing this action but OFT and the courts!! They said they couldn't do anything for me and that I will just have to wait until the courts decision next year! Any more ideas? Or do I just have to take no for an answer?

There's some really useful information on this site but i'm still not sure what I should do in my current situation.
I am a student going into the second year of university. Before I started the course I had an HSBC account with £1000 overdraft which I maxed out. After HSBC declined my application for a student account due to a bad credit rating I opened up a Natwest student account with £1250 overdraft which is now also maxed.
So I am now in a situation where I have £2250 overdraft debt, plus £500 HSBC credit card to be paid off, all incurring interest charges except the Natwest overdraft. I want to reclaim my HSBC bank charges but have nowhere to put my overdraft as my credit rating is even worse and there's nothing left in the Natwest account.
I was wondering if I should just go ahead with reclaiming and then close the account, fill out an income expenditure form and give them the minimum weekly amount to pay off my overdraft and credit card. But I dont know if a) they would let me do this, or b) if it would stop the unaffordable interest charges I am getting at the moment, or c) if the credit card and overdraft would be counted as separate debts or a single debt.
My finances are one big mess so any advice would be appreciated.0 -

A bit of advice would be appreciated please.....
Submitted my court bundle to court (copy to Barclys lit) just prior to the announcement at end July, now all on hold. During the negotiating period Barclays offered £1215 (against £1620 + int) and I said NO but I would acept £1500. They may no response hence the court procedure.
Is there any mileage at all in writing to them to say I am still willing to accept the £1500 as suggested in my letter of ......... or is this a complete waste of time. And if so does this need to be 'without prejudice'. (Could do with the money!!!!)0 -
I recently took the Halifax to court for reclaiming of bank charges, however now that it has got to the Bailiffs stage, they have returned it as I only put a PO Box address. Can anyone tell me which address I should be sending the bailiffs. Don't want to sllip up now!0

Hope someone can give some advice...long story short ive reclaimed back £1651 from Nationwide,however they sent the cheques (two) to my previous address.
I wasn't aware of this until two days ago when the solicitors acting on Nationwide's behalf wrote to me informing me i had to now drop the case (court was due today 31/08/07) and sign declaration and return to them.
I called Nationwide the day after receiving letter and they advised me the cheques had been sent out on the 26/06/07 and was cashed two days later...im now told by Nationwide that despite the fact they sent them too the wrong address (they have my current address and have done for several months) and despite someone other than myself having cashed them (Not presented through a bank but CASHED.?) im now told i have too wait until they find out where they cashed them and who actually cashed them until they will consider refunding charges Ive never actually received.
Maybe im being a little naive here but surely if the bank has sent reasonably high value cheques to the wrong address using the normal postal service and they have been fraudulently cashed then how can they refuse to pay me until the case is settled ,ive been given no explanation of how its possible to cash a cheque considering it was made payable to myself A/C Payee only....and where this has taken place,what happens if they never find out what scum bag has stolen them.??

They wrote to me replying to my claim for bank charges (too my current address) six weeks before sending the cheques.
They said yesterday (yet again changed there story) that the reason they sent the cheques to old address was that the address there solicitor's had for me.....and not because i hadn't notified them of a change of address.
However the solicitors wrote to me at my current address and the court paper work states current address so Nationwide through there incompetence have lost THERE money....as far as im concerned i still haven't been repaid.0 -
My claim whilst only a modest small is baffling me at the minute, today I received a letter from the local court to where it was transferred to asking me to file them and service the BS with 1]the dates with evidence, 2] what charges are being sought and 3] the reason why I want them back....but they already have this information when I first filed the claim....so what their game...?????????0
