Reclaim Unfair Bank Charges article discussion Part II

  • I am trying to get my money back from Abbey and I have received a letter from Hull County Court (District Judge Besford), that states;

    "IT IS ORDERED THAT

    The claimant shall comply with the following directions by 16:00 15 August 2007.

    a. The claimant shall file and serve a statement setting out particulars of the breach of contract and any explanation (if such breach is alleged). The statement shall exhibit a copy of the relevant bank terms."

    I think this means they are asking me to say how I think the bank has breached it's contract, but I'm really not sure how to write this and where I would get a copy of the relevant bank terms.
    I presume I just have to ensure that they have the documents on time, but do they have to be in any special format/ type of fancy paper?:confused:

    thay have not ask for nothink ??????

    i rang the court thay said i was on :eek:

    what do i do i am sh*ting my self :eek:

    the bank has ask for a stay

    but i sent them a fax saying that i need the case to go on as i am in financial difficulties as the bill are big and i am on low income & tax credits :eek:

    Do what that says and change the bold print to your details...just do the Particulars of Claim and not the bit above, also attach your schedule of charges (again) I know...but you must do that to comply and also it looks like they are asking for T&C of your contract, supply the one when you opened your account.

    Tell them you will have the Stay set aside on a basis of (HARDSHIP).

    cross yourself over to the getting a defence for a stay thread and take a read...but yours sounds like a hardship case to me and the courts are taking preference on granting stays
  • I am usure if my claim is still going through with the Abbey, I started my claim back in April 07 for £3,422. After several letters stating it could take upto 4 weeks and if they are still investigating they will update me in 4 weeks, I recieved a letter stating they were going to credit my account with £600 as a good will gesture and that if I was still not happy with that they would keep my file open for 8 weeks.
    I wrote back stating that I was not happy and that I would pursue court action to seek satisfaction. I also added that I would accept £1,800 if they responded in 14 days.
    The 14 days were up today and I have not heard a thing:confused: , is anyone else in a similar situation??? I would have thought as they stated the case would stay open for 8 weeks they are obliged to honour and carry on with the case.
    Can anyone shed any light on this or give any advice?

    I was a customer of The Woolwich, which has now been taken over by Barclays bank. As The Woolwich is no more, who should I send my bank charge claim letter to? :confused:

    your account number should have changed by now and personally i would still refer to the title of Woolich and quoting that account number but still address it to Barclays.

    I'm sorry but I'm not very good at this. When I click on the link it doesn't take me anywhere. I have managed to look on the forums page, but don't quite understand the "&postcount=120" bit, any more ideas?
