I have a court hearing date about my bank charges from HSBC - and on this form is says that I should send into the court and to every other party copies of all documents on which I intend to rely at the hearing.I have already sent a copy list of all charges with dates and descriptions of what each one is for to D G Sols and also the the local county court but is there anything else I need to send in like copies of all my letters which I wrote to HSBC or will just the list of charges do?

You need to read the Court Bundle Checklist...

    Afternoon Everyone,
Just wondering if anyone out there could help me please??
    ******************************************************************
I have a court date fixed for the 30th August at Wolverhampton Crown Court against the Alliance & Leicester, where they have informed me that they intend to have my claim "STRUCK OUT"

So i have contacted the court today to be told that i need to get my case together and submit a COURT BUNDLE? to back up my case (just in case it gets to court!)

So my question is could anyone please tell me what needs to included in this bundle please, as i'm not too sure!!

    Thenks in advance

What reasons have they given for having your case struck out? If its because your Particulars of Claim are "embarrassing" or similar you'll need to re-do that.

You'll find the Court Bundle Checklist thread here...

    One more question....

Do i phone the court to tell them that they have settled and to cancel the claim or am i best off waiting for the dollar to transfer into my bank?

Well done on your win :j Wait until the money is in your account before you cancel your court case.
  •
I've been claiming since April as well, i got the rejection letter but rang up and asked them re evaluate my case (about 2 weeks ago) which they did and have now offered me £200 (which is to debited into my account within 14days) but i was originally asking for £425 so now im going to call them in a second and ask for at least 75% of the £425;) . I will come back and post their response.

    Hi there,
I tried ringing and said I was aware of the case but not happy with the result and that I wanted my particular case referring. Halifax told me that no-one could get their cases reviewed now and that it wasn't them enforcing this action but OFT and the courts!! They said they couldn't do anything for me and that I will just have to wait until the courts decision next year! Any more ideas? Or do I just have to take no for an answer?
  • I have now filled my letter out, When sending letter do I have to list all my individual charges in letter as this will be a endless list, or do I just put a total figure that I want to reclaim back
  • Hi can anyone help me. My husband received court papers from Newcastle County Court on Thursday informing him that he is to attend court on 8th November for a hearing about his charges. He has also been informed that he needs to pay a further £100.00 prior to 17th August if the case has not been settled. Will the case actually go to court on 8th November

    Any help appreciated
  • Can anyone advise please? Today Ifinally received statements from BOS.Request was made in May.What I would like to know is from which date do I count the charges from?Would I count back 5 years to August 2002 or would it be May 2002 seeing as I made the request in May this year?

Hi everyone. Just returned from 2 weeks in France, and knew nothing about the 27th decision. I have received the bulk of my refunds from Barclays, but this explains why they have ignored my letter requesting the refund of the subsequent charges! However, my question is - my husband has a court date of 23rd August for his hearing - on return from holiday he had a letter asking him for the Application fee of £100. He phoned them yesterday, before I had had chance to log onto here, and asked what it was about, and they explained about the questionnaire and the fee to be paid. Not wanting his claim to be struck out, he paid the sum over the phone. Will his case go ahead now? If not, should the court have not taken the fee, which I assume will not be returned until all of this is sorted out.

Or perhaps being so far down the line Barclays will offer him the out of court settlement, as they did with me, 10 days before. What should he do?

I posted this a couple of days ago, and can't see if anyone has replied. We have submitted the court bundle to the lawyers for Barclays and the court, and they have taken his £100. If they put a stay on this now it means he is £220 down on the court fees, which is harsh considering the case is due to be heard on the 21st August. However, we have heard nothing yet from either the court of the lawyer. If you are the claimant, can Barclays have the hearing stopped?
