  • Ive put in a claim to RBOS more than 8 weeks ago now and ive heard nothin back. I have called them 3 times and each time was told to be patient.

    My patience is running out and was just wondering what i can do now.

    Any advice would be helpful

    I got my court stuff saying that the case is transferred to Preston from Northampton. Defence statement is about 3 pages from Barclays.

    It says that Allocation is dispensed with but how do I find out the date the case will be heard? I've little doubt my friends at Barclays will get a stay but you never know.

    I have a court hearing date about my bank charges from HSBC - and on this form is says that I should send into the court and to every other party copies of all documents on which I intend to rely at the hearing.I have already sent a copy list of all charges with dates and descriptions of what each one is for to D G Sols and also the the local county court but is there anything else I need to send in like copies of all my letters which I wrote to HSBC or will just the list of charges do?
  • I have today recieved a letter from the FOS stating that they will not progress any complaint concerning bank charges because of the pending High Court action to verify the law.

    Obviously the FOS are colluding with the OFT on allowing the banks to suspend making repayments to their customers. This is a total disgrace, the banks should be forced to continue the repayment of charges to those customers that have already logged a claim with them.

    If the banks lose the High Court case, of which I suspect they will, then will they being paying interest on the monies outstanding from the time of the claim was lodged with them to settlement date? I suspect that tey will use a loophole and get away with robbing customers even more than they have done to date.

    It is also suspected that, if a customer lodged a complaint through the County Court system, this wil again be held up by using the High Court action as an excuse, and the Judges staying the claims until the result of the clarification of the law is published.

    God luck to everybody who have/are/is reclaiming bank charges. A special thank yo must go to Martin and the team for raising the profile of this issue, without them, those who have had a success against the banks, would not have done so without MArtin and the team.
  • I have been offered a lesser amount than my claim as a full and final settlement. The letter states that if I accept, whilst I would not be precluded from claiming the remainder of my claim, it is unlikely I would be awarded a further sum even if the banks lose the test case. Does anyone know if this is true? Also, has anyone written to accept their bank's offer, but stated clearly that it is not full and final settlement? If so, has the bank paid?

    I have a court date fixed for the 30th August at Wolverhampton Crown Court against the Alliance & Leicester, where they have informed me that they intend to have my claim "STRUCK OUT"

    So i have contacted the court today to be told that i need to get my case together and submit a COURT BUNDLE? to back up my case (just in case it gets to court!)

    So my question is could anyone please tell me what needs to included in this bundle please, as i'm not too sure!!

    Under the court rules you are supposed to use the registered office address so there is no reason why you cannot send in the bailiffs
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    You should apply for judgment in default ASAP as the bank might put a defence in first.

    congratulations beannie I am a bit peaved because my case and all the others for 14th August in Cardiff have been 'stayed' by the judge!! it took from January to get this far

    coedmeiri you were lucky they put the money in your account, I was offered £705 as a goodwill gesture on my claim for £1091, but I never saw it. I wrote (as suggested by 'edinburghlass') " I accept your offer of £705.00 as a partial paynebt and without prejudice, but if I do not receive the full amount within 14 days I will be proceeding in the county court" Now I could be waiting years to see anything, but I made my choice on principal to go for the full amount.
