  • good day all

    just some advice on what to do next i sent all the letters out from this web site and got no where.So i filed a claim out in my local court on the 11.7.2007 and was served on the 27.7.2007 giving them to the 10.8.2007/4 pm. I rang the court and no defence had been put in. Do i go to court on monday to file judgment if so i will be knocking at the courts doors for 10am on monday.
    but i put claim in for the local bank addres is this ok ?

When he could see I was not going to back down on any of these points he then entered into negotiations and we agreed a settlement figure – exactly in line with what I was prepared to accept PLUS all Court costs.     How you got that many charges in 6 years is a mystery to me, but who cares about that? Not you!!!! Enjoy it mate, lets hope Lloyds give me my £600 back.

    I am amazed you got that amount back, well done for standing up to the barrister. is it a business account, if so can I claim business charges for an account which is now closed due to retirement it was our own small business??
    Anyway with reference to my case which was due to be heard 14th August, the judge has ordered a stay and vacated all of the cases. For some reason it is transpiring to be Wales who are ordering the stay and England are still hearing and winning, did you read about Kingston, I wish I could transfer to there!!

    Any news on what happening with Cardiff on the 14th. I now theres a few of you on here, and you've all abjected to the stay?

    They paid extra.... we didn't ask the Judge awarded it for interest occured from Jan to Aug :D

    Went to court today the barrister was there for Barclays, they tried to postpone due to Other case, although the Judge asked them on what grounds and to explain, at what time they had no answers for him. :confused:

    So they settled in full there were 2 other cases there and they also won :beer: :beer: :beer: :j :j :j

    CONGRATULATIONS!! you lucky duck I am sick as a pig that my claim has been "stayed" by Judge Hickinbottom Cardiff Court pending the outcome of the test cae:mad: :mad: Apparently it seems to be Wales this is happening and in England cases are going ahead

    Hi, yes jonesys I have sent in my objection and request for the stay to be lifted and we are all very very angry about this I think everyone has sent in the objection but i wonder if Judge Hickinbottom will even bother to look
  • just looked at online statement dd bounced £7. 99 above the dd is a payin of£900 same day seems Nationwide will continue to steal our money until this court case is finished. I know if I write to them they will probably repay the charge, BUT they havant taken it yet because they let you know at the end of the month with another £20 charge for beeing 37p overdrawn. IN the last 6 years Ive already paid £600 incharges so I will just add to the list and hopefully get it back just like saving really. I have cancelled nearly all my dds now and I pay over the phone now abit inconvenient but this is the first charge for six months :confused:

    coedmeiri you were lucky they put the money in your account, I was offered £705 as a goodwill gesture on my claim for £1091, but I never saw it. I wrote (as suggested by 'edinburghlass') " I accept your offer of £705.00 as a partial paynebt and without prejudice, but if I do not receive the full amount within 14 days I will be proceeding in the county court" Now I could be waiting years to see anything, but I made my choice on principal to go for the full amount.

    Cardiff Court really seem to be messing people around. I've been reading the thread here and have worked out that there are about 12 of us who have had this date put off. I rang the court last week to be told that they had sent me and my other half (both due in Court on the 14th August) a letter stating the case was being 'stayed' by Hickinbottom. I also had a letter from DG Sols saying they were going to ask for a stay. Rather than rely on good old Royal Mail we hand delivered objections to the 'stay' on Wednesday as we hadn't had the notification from the court. We were told to write a letter instead of using N244. I followed this up with a call yesterday to be told that we had both been sent out a letter from the court on the 6th saying they were applying a 'stay'. I KNOW THAT BUT WHERE IS THE LETTER!! This arrived today!!! I was also told by listings that judge Hickinbottom had placed the 'stay' and that there was only one judge who could lift it - guess who??? JUDGE HICKINBOTTOM!!!! Surely this can't be right?? So not only did we get the 'stay' letter today (Saturday) but the same judge is placing and lifting (not) 'stay's' and it would have left us with very little time to respond. What a mess. We've been told not to attend court of Tuesday - I was atill going to go. I've had to take time off work too!!

    i have also been messed around. Iam due in Llanelli court on Tuesday and didnt find out until yesterday that the judge had agreed the stay. i would be really grateful if you could PM me the legalities you stated on your letter to the judge. i have noted my opinion on why the stay should be overturned includeing my hardship but am still a bit stuck on the legal side of it. Hope you can help? and good luck
