    Welcome to our 'unhappy' family!!! :o Not sure if you've been in touch with the court or not but there is another sitting due for bank charges on 14th November (according to the blokey in listings). Bearing this in mind and following the letter I received from the courts, I'm wondering if Judge Hickinbottom may see all the people who have asked for the stay to be overturned on that date? The court letter stated that if the stay was overturned the case may be heard in about 3 months time?? Failing that the details accompanying my official court letter stated the test case is due around January/Feb next year.

    Who knows - guess we'll have to wait and see but in the meantime - keep in touch and lets keep it all going and the presure on. Good luck:o

    I only received the letter of transfer from Pontypridd to Cardiff last week, I havent been in touch will Cardiff court dont know if its worth bothering...I will watch with interest to see how your case is going...I was really hoping for the money before Christmas...doesnt look like now though :o ...did you have an AQ to fill in or has Cardiff dispensed with this...I have received the letter from Abbey which says that they will be requesting a stay on all cases until the outcome of the OFT test case, the judge hearing my case is not Hickingbottom it is District Judge Hendicott, I read somewhere on the forum that it is up to the individual judge,do you think he will see things differently or am I clutching at straws:confused: ....

  • I would greatly appreciate ANY help with this! Basically, I am taking Barclaycard to court, but they are being real b***ers.

    STORY SO FAR:

    I applied for statements, worked out how much they owed me and filed on MCOL for my court hearing. When Barclaycard originally responded to my threat of court, they offered me £181 - they actually owe me over £600. I said no, but they put it on my account anyway. I have written 3 times asking them to take it back, but they haven't. I don't want them to be able to use this as a weapon in court. Is this a dangerous situation?

    Anyway - I have a Pre-trial review on September 10th.

    THE BIG QUESTIONS I WOULD GRATEFULLY APPRECIATE ANSWERS TO ARE:

    1: What do I need to take with me or be prepared with for the Pre-trial review?

    2: How dodgy is Barclaycards forced gift of £181 and where do I stand if they don't take it back?

    I also had a Judge Hendicott somewhere along the line and then it changed to Hickinbottom. They dispensed with the AQ - presumeably because of the amount they had been sending out, I would have thought it woudl have send on your transfer details although thinking back I think it says on the next document you received from the court. It may be worth ringing the court anyway just so they know you're on the ball. Have you got your court bundle in yet? What date was set for your court case or haven't you been told yet? If you haven't - maybe they'll put you in the 14th Nov sitting (if it still goes ahead)? In that case you'll have plenty of time to appeal against any stay. I think the ones set on for the 14th Aug were a bit rushed by the judge.:o
    Important thing is to keep going with it and make a nusiance of yoruself!:T

  • I'm in a bit of a pickle I got the information a while ago about what charges had been incurred from my banks but have not acted on this since. Now with the pending court case i don't know if i should continue my claim or not.

    hi jayneo and jonesey, If you have looked on the CAG the info is on the Cardiff Directions Hearing site loads of it, the Application to uplift, the objection letter, and now the letter to send to the MOR ,OFT, MP ,RODRI MORGAN ,CCC or whichever you think will help
  • Has anyone got a link to the "Stay" thread. My hubby got a letter from Barclays on Friday saying they had put a stay on the court case - nothing from the court. I had spent two days photocopying the bundle - do you suggest ringing the court to see if they are going to put a stay on? He is livid as he only paid the £100 application fee to the court last week, and he is now even shorter of money, and his firm closes down at the end of the month, leaving him out of work. It never rains.......!

    I am amazed that a defendant can put a stay on a case which has already been allocated. We could all duck and dive on anything to see if the law is going to change. Surely they should turn up to defend your claim against them. :mad:

    Well,
    As I said in an earlier post, I got offers for both business and joint acc.
    I expected a cheque for the joint account as it is now closed however it has appeared in the business account( Husbands name). BOS made a ba!!s up again.He is going to withdraw this amount in the morning and then call and ask where the business account refund is. If they intend sending a cheque for this, they can think again, as I would need to wait another week on it clearing,

    we have a claim going through , it started 24th april this year, we recived a letter from natwest bank 'thankyou for your letter etc... we are looking into your claim and could take 6-7 weeks ' but today we received a letter dated 8 august and the letter says' we refer to your letter to bank charges and we see they are lawful etc... then all this jargon about the test case . i'm not sure what to do now , do i wait for the test case or carry on as my claim was in befor the test case came out please help me as the money being claimed is £3930 and could really do with it now thanks in advance
