thankyou for your help,
i'am going to send them the next letter but while i'm waiting for them to reply as they will most likely use the test case an an accuse i want to get my court claim ready where do i go to file the claim on mcol, i have a county and magistrates court where i live

I'm really glad that all the people on here have been sucessful and happy for you, but is there anyone still hitting their head against a brick wall, I feel I am. I have been fighting with Halifax for ages, firstly I used a company to get statements and then got rid of them as they were just fobbing me off and that was back in January, then I took over and got a list of charges which I used all the process on here to follow, then they sent statements in full, then I offered them to settle early of which they sent the standard we are in the right letter, I called them and was very polite but informed them that I would take them to court of which I paid and started that process, they put in a response which gave them more time and now they have defended. I am awaiting to hear from the courts but have received a defence case from their solicitors Optima, I think it is standard having read through it, but its just getting me down now that it seems to be going nowhere and I'm very unlucky! Is anyone else in this position, I'm sure there are! Also could someone direct me to the threads where I can find out the hints to not letting them get a stay in court.0

i am claiming against a&l in court, they defend my claim about 7wks ago & was just wondering because it is in the court system it will still go ahead with this big FREEZE OR STAYwot ever they want to call it.

Thanks for that Devan2 I will look in to that. Also Lou1973 I am in the Bury Lancashire area, but the claim went through Northampton so I am awaiting directions from them.0

I thought I had posted this yesterday, but can't see it, so apologies if I have failed to spot it; however, I thought you may be interested to know that my hubby went to the local Court yesterday and took the letter of "stay" from Barclays with him, along with his bundle. The court have told him that his case will go ahead as it is so close, and that they are hearing all cases up to, and including the 21st - the date of his hearing! So he left them the bundle and posted one to their lawyer. One assumes that he will now either receive an offer before then, or they will assume the stay has been granted and not turn up, so he will win by default.
I am now starting the court process for a second time myself against Barclays for the charges levied since submitting my original claim. They are £700, and they have failed to respond to my letter asking for them to be refunded. I assume that I can go through the process again?0 -
My MCOL claim has been transferred to my local county court, and they say that "The filing of an allocation questionnaire be dispensed with in this case unless the district judge at the court of transfer orders otherwise". They have under Rule 23.3 within 14days to apply for a stay.
At the same time Abbey has sent the letter about the test case and saying all the claims have been stayed.
Is my claim still going ahead?
Will the county court send me a questionnaire?
How do I go about defending my claim?
