    Don't suppose you have a link for these do you? Just come off nights so brain a bit fuddled and can't find it!!!:rolleyes: Court case was due today so not sure what we can do now. I did get a letter in asking for the stay to be lifted and the case to be 'struck off' as DG Solicitors didn't get any defence in but not heard anything. Do you know if there's anything we can do now or do we just wait??:confused:

    I have just received my bulk of bank statements, do I proceed to the next step or just hold on now.

  • As per earlier post I explained that I recieved a good will payment of £685 and that if I was not happy my file would be kept open for 8 weeks.
    I replied and explained that I was not happy at all on the 26th July, I faxed the letter to Abbey and posted a hard copy.
    I also stated I would accept less if they agreed within 14 days, that time has come and passed:confused:
    I called today to establish what is going on and they claim not have recieved my Fax nor my letter:mad:
    I have escalated it over the phone to stage 2, yet they state that it is now on hold...how can this be when the letter states 8 weeks. I have now re-sent the letter with a covering letter by Fax, E-mail and post.
    This has been going on since April 07......should I go down the MCOL route as I could now really do with the money as the CSA claim to have under-calculated my payments for the last 2 years and are looking for payment by the end of November:confused:
    Any advise of direction would be welcomed

    Depends how far back you are claiming and when the bulk of your charges was taken, unfortunately the only way forward is to file a claim, as for the CSA if you have got the amount that you underpaid by tell them you cannot afford to pay it all in one lump and could they spread it out over future payments. Not forgetting ...depending on the size of your claim could incorporate a fee from £35 - £250

  • I've just put my claim in online today. If the bank doesn't respond in the timeframe will the judgement still go in my favour in the light of the test case stay?

    In reply to tracy carry on as normal you can still file a claim on mcol by all means inform your bank first of your intention give them 14 days to respond, if no response then file your claim. In reply to vapcq yes judgement will go in your favour. We/They still have to comply with court orders.
  • Thanks lindilou39 - you're a star. I've invested £250 in court fee..fingers crossed I get to see it again.

    i'am going to send them the next letter but while i'm waiting for them to reply as they will most likely use the test case an an accuse i want to get my court claim ready where do i go to file the claim on mcol, i have a county and magistrates court where i live
