  • Hi just to let everyone know, I have just had £1200 credited into my Lloyds TSB account :j

I followed every step that Martin advised and it got to the "threatening to take them to court" stage and guess what I got a lovely letter from Lloyds TSB saying that they will credit £1200 into my account within the next 5 days  Amazing what they can give you if you are persistent with them. I'm over the moon :D

Hi, that sounds great, can you tell me what address was used when you sent the letter threatening to take court action? Thanks

The address on all of my correspondance is:

    Lloyds TSB Bank PLC
    Customer Service Recovery Centre
    Charlton Place
    Andover
    Hampshire
    SP10 1RE

If you have already sent them letters following Martins step 1 and step 2 etc then you should already have this address if they have sent you a letter.

Hi, yes have received the letter just wanted to confirm it was the same address therefore they might deal with mine in the same manner. How long did it take from you sending 3rd letter to receiving your offer? Thanks very much for the advice.

It took them just over 4 weeks to send me the letter offering to repay in full. To be honest I thought that they had just ignored my threat to take them to court and I was going to send them another letter that week and start the court action then a letter dropped on my door mat on the Saturday saying that they will repay it all inc interest on this occasion :T . 3 of my friends are with Lloyds TSB and they received exactly the same letter, it must be a standard letter they send everyone. Good Luck I'm sure you will get what you have asked for.

Thanks to this site I have had success reclaiming penalty charges from NATWEST (twice) and HSBC without the need of having to issue court claims! (see report success forum) :j :j :j

However, I am getting very frustrated with CAPITAL ONE as they are playing "ping-pong" with me between themselfs and the Lowell Group (a parasite debt collection company) who Crap One say they have sold my account to.

What should I do? Should I just start a County Court Claim with just the information I have ( Crap One & Lowell Group won't supply me with my remaining statements) But I have the evidence to prove a claim for penalty charges of £491.00 plus interest = £702.54 on a card with a limit of £200.00 (again see success forum for more info)

HAS ANYONE HAD A FULL REFUND FROM CRAP ONE WITHOUT HAVING TO ISSUE A CLAIM??????????????????

 Their tactics are making me mad!!!

    Opinions please?

Filed against Barclays beginning of may using moneyclaim. Letter sent offering 2,100.00. Rejected.

Had preliminary hearing yesterday and a representative of Barclays was present. After a 20 min discussion the judge concluded that there will not be a strike out at the agreed hearing and will be happy to listen to either party. Stating regularly that Barclays will have to present evidence that the charges are fair. The judge also shown unhappiness at Barclays in relation to time wasted in the courts. Should I prepare for Barclays to actually show? The judge seemed willing to take further. Please help if Possible, Regards Blinxster

As they will not produce the statements, your option is to tell them that they are knowingly prohibiting your riights for this information and you will bring this to the attention of the court.

Regarding the Lowell Group, tell them the same and advise them not to make further contact until they provide this information.

Barclays are being a bit brave to send a representative to court ???
The judge has now invited Barclays to provide the information, a smart move.

If Barclays do provide the information (something we all want to know), they will be the first bank to do so, leaving all banks wide open to mass refunds which could run into £££billions.

The judge seems to be on your side so sit tight, the chances of Barclays providing such information is very remote.

I was also surprised that somebody from Barclays was at the court. I will Post the outcome of this matter when resolved. - Blinxster

    Hi,

Keep us informed on this one.

I've just served on barclays the particulars of my claim (inventory of charges, etc) and also asked them to reveal their costs (which I'm sure they won't) so that I can illustrate that these charges exist to line the pockets of the bank. I'm hoping they'll get slightly nervous and settle.

I think everyone serving the particulars of their case ought to include a polite letter asking that the bank reveal their costs. If we're including this question in enough AQ's, then if enough judges demand the banks reveal their costs, at some point the pressure cooker will blow and there will be a test case. Afterall, a change in policy is what is needed. Do the banks really think they can keep this up forever? I wonder...
