Reclaim Unfair Bank Charges article discussion Part II

Hi People, I have just read a post on the CAG website( posted by JAMES33) that says you can't claim interest until you go to court!!!
Is he right? I'm in the process of claiming back £2996 from Abbey for me (sent first 3 letters and had no reply, so now just waiting for 8weeks to be up to go to FOB about it)and £1970 from Nationwide for my hubby-2-B (sent 2 letters got the go-away-we're-not-paying letter and they advised us to go to FOB if we're not happy so thats what we did!) I included interest on both of these using the great templates and calculator from this site.
Help now I'm panicing....Have I ruined our chances of getting anything back?
Thanks
No you haven't ruined your chances, have a read of Martin's article and listen to the audio file regarding interest where he suggests you start your claim including the interest but as this is awarded by the court don't expect the bank to include it in any offer you may receive before going to court.

Hi everyone.
I am getting really worried now as (having been throught the whole process), we now have a hearing date of 19th September!
The bank did offer us our money back but not the interest (£3700) but my husband (in his wisdom) decided that we should hold out for the interest as well (about another £700), as that's how much they took from us after all.
Does anybody know whether this affects our chances of winning the case(assuming the bank don't pay up first)?
The whole process has now cost us £220 on top of everything else (MCOL and court charges), does anyone know wheter the court will add this to what the bank already owe us?
Many thanks in advance.

I have tried searching for information on this subject but am new to this forum so forgive me ( and please point me in the right direction) if it has been answered before but I am asking if it is possible to reclaim charges made by my building society for late payments etc. or does this only apply to the banks?
Thanks for any help.0 -

Hi
Well it's scary business especially a single mother taking on Loyds. I sent my letter on 10 July asking them to pay with detailed charges as I had the majority of my statements already. I received a response on 20 July, lengthy letter explaining that like other business they charge for their services, blah blah and more blah blah. There was a paragraph asking to let them know if there is anything else they can do. The said if we cannot come to an agreement, I will provide details of the Financial Ombudsman. Do you think they are inviting me to negotiate and offer?0 -
bank of scotland
claimed £14.125
Started the process as per your advice, after 4 weeks letter to say they would not repay anything as it was a business account, Is there perhaps a problem because it is in Scotland, or should I keep trying?0
