    Hi,, was wondering if anyone who is claiming off Nat West has had a letter saying they are looking into it,, and that it will takes 6-7 weeks,, if so did you hear from them in that time and, if not what you did about it,, also is there any template letter to send them,, Ive been waiting 6 weeks.

    They will keep "gorging" on your account. Whatever they add today, you claim back from Natwest tomorrow OK.

    The reason they keep applying these charges is simple. If they stopped it would mean they are wrong in making these charges and they will not admit to it will they. Natwest like every other bank doing the same has firmly placed itself in a "catch 22" situation.

    Let them play their game and just keep claiming it back. You should write a letter with COMPLAINT at the top refusing permission of these charges unless they can explain how they are calculated. If they continue, which they will, and they have not given you a breakdown, the charges can be deemed as unlawful and therefore not recoverable in law.

    Natwest know this, all the banks know this, so we just play their game and keep on asking for a refund

    Can you tell me the number you called to negotiate with Abbey? I have just called them to try and get a bigger settlement than the 65% they are offering me and they have told me I have to write back to the with a counter claim.
    I don't mind doing this, but if there's a quicker way to do it.....
    Also, when I write back with a counterclaim, does anyone know of an appropriate wording I can use?

    I claimed from these in February and received the same letter and did get my full refund eventually about 2 weeks later
  • URGENT - need to set out a 'consise statement of facts' by 4pm

    My case has gone to county court (me Vs Cahoot for £770 including interest). The district judge has ruled that my case details (I used the template layout of facts from this site) along with copies of all statements including charges and a summary.

    'make no serious attempt to comply with CPR 16.4 (1) by setting out a concise statement of the facts'

    'The claimant must ammend or substitute the particulars of claim by including details of the charges complained of, how they were calculated and in what circumstances they were incurred.'

    At the foot of the letter it also rules I must do this by 4pm on the 29th June - which is today (I returned from a two week holiday at midnight last night and had not received this letter before leaving).

    I called them and there is no judge in today who can extend the deadline...

    Can anyone help???????

    [FONT=&quot]I have been reclaiming bank charges from Lloyds TSB, and have issued a small claims court order. They have replied with a defence and I'm now trying to prepare in case of having to go to court but I'm unsure what their defence means.

    Can anyone help?

    This is their defence:
    1. The Defence is served without prejudice to the Defendant’s contention that the Particulars of Claim is insufficiently particularised and is embarrassing. The Defendant reserves the right to plead further to the Particulars of Claim once they are sufficiently particularised.
    2. The Defendant will object that the Particulars of Claim in this action disclose no reasonable cause of action against the Defendant and makes no specific allegations against the Defendant as to why the Defendant should be liable to the Claimant for the amount claimed.
    3. The Particulars of Claim do not comply with the Rule 16.4 1a of the Civil Procedure Rules as 'amongst other things' they do not identify the account in question that appears to form the subject matter of these proceedings, or indeed show how the sum of £681.50 is arrived at, and there is no pleaded basis in law and fact for the claim itself, the Particulars of Claim are too vague.
    4. The Particulars of Claim shows no reasonable grounds for bringing the claim and should be struck out pursuant to rule 3.4 2a-c of the Civil Procedure Rules.

    I believe they are saying that I have failed to provide them with enough evidence as to what the charges are, how I've come to the amount, and that I haven't provided an account that I claiming the charges are from, all of which I have provided to them twice. Are they just trying to confuse me or does their defence imply something else?

    I strongly urge you to ring Natwest during the coming week. I have now handled four Natwest claims, and all were settled in full, after the person i was helping rang up.

    I wouldn't mind but because they took out £38.00 yesterday without me knowing my mortgage hasn't been met today which means my mortgage company will also charge me £35.00 for a late payment

    Do they not care that they are putting a huge strain on ordinary hard working people with young families. This is the second time this year that my mortgage wasn't met because Natwest taking money from my account without letting me know first.

    I have a relative who is a bank manager and they are going to the carribean as one of their bonuses in a couple of months. (WHICH DISGUSTS ME) - Now I know who pays for it - WE DO!!!!!!!

    Does anyone know if I can claim the £35.00 late payment charges from my Abbey Mortgage company.

    Well Done, congrats! :T :T Hope i get the same result!! How long did it take using the FO? I had a letter of them dated 20th June saying they are passing the complaint to casework admin area to await allocation to an investigation team.
