My advice would be to write and advise you are aware this is a retaliatory action for reclaiming your charges and to offer a monthly amount to pay off the overlimit at a rate you can afford. You can always advise they will be paid in full on settlement of your court claim and it is in their best interests to settle the matter at this point.
Given that your court date is so near it is a viable option to use your credit card to pay it and then reimburse the card with your refund but I wouldnt do so until it is absolutely necessary. Do not take their threatening letter as their last word on the matter and write to them discussing options. This will at least give you more time. If it is their final response that it must be paid then use the card. There is little chance that you will lose your claim if you have followed the procedure laid out on this site.

Thanks again Twinkly. Iwill certainly follow your advice. I have followed the Court Bundle from the tmplate and spent all day Sunday numbering the pages and getting it all in order. A small forest will go when I print two copies of that lot tomorrow to send to the court and their lawyer!0 -

Not sure if I've got this on right or not but need to ask for advice. I have put a claim for bank charges into the small claims court and after some confusion the local court (Great Yarmouth) has accepted my claim on the 14th June. They have however decided to hold a preliminary hearing but not until the 25th September. Is this usual proceedure or is the delay unusual?0 -

This isnt unusual no so dont worry too much. The dleay is probably due to the courts being so busy and nothing more. Ring the court to enquire as to your particular case if you have any questions regarding the procedure but there is a guide here that may help you understand further what the hearing entails:

Phone call to say i wasnt happy and then offered £2000 25.6.07
I know i could have pushed for the ul amount but i am sooooooooooo happy with what i have been given. I didnt think i would ever get this amount back. This reduces my debts big time.

i wonder if someone could help,
i sent first letter of to hsbc to reclaim charges and got usual response ,so i was hoping to push on with claim so i emailed them instead of second letter to say that i just wanted to let them know that i intended to start court proceedings within two days but was giving them chance to pay back charges without court costs on top.
i had email back saying that the bank had been given 8 weeks to resolve the complaint from date of first letter.
what i would like to know is should i carry on as i have said or should i send them second letter and then start court,

I have today received my history of charges from alliance & leicester, whilst checking for charges I noticed that there were a number of instances where I had gone over my overdraft and not been charged the usual £25 unauthorised overdraft charge. After looking in to it further in these cases my monthly overdraft fee has increased from £5 per month to £25 per month!!! In one instance I cannot see any reason for being charged the higher amount. They have occurred randomly over the last 6 years, reverting back to the £5 charges on all of my other statements, whether I have had an unauthorised fee or not.
Are these a sneaky way of charging me the unauthorised fee and can i reclaim them in the same way? I wouldnt have noticed them if I hadnt been looking for O.D charges!
Has anybody had a similar experience with A&L?
I have just called A&L about this (as soon as I mentioned charges they became very hostile!) I was told that the 'monthly overdraft fee' increasing to £25 was the same as an 'unauthorised overdraft charge'
I would urge people to look through their statements very carefully, I didnt initially check the monthly fees as I know these cant be reclaimed, I now have another £100 to add to my claim.
