Full amount incl charges: £2094

Hello all,
just called the bank and got offered £1710 (charges amount without interest) instead of the £855 that has alrady been paid to me. Thing is judging from all the processes, I have been through on this website ,I might be able to claim £2094, which is the full amount + interest. If i want to do this , I have to apply through the online court system. I don't know whether i am being too greedy or not but the thing is if i get that extra I will be able to cancel all my debts but if not I might still have some left. I dunno whether i am being too greedy or not!
What do you all reckon? I'm not too confidetn about going to court!
P.s . spoke to the lovely Graham who is dealing with my case. He has told me in oredr to claim te interest, I have to go to the courts but if I take the money its final. What to do , what to do?0 -
i had a defence letter off abbey yesterday offering to pay me 65%of my claim as they say they should be allowed to charge something should i accept this offer or should i reject it and carry on with the court proceedings if i accept they want me to withdraw my summons once the money has been paid0

Since you havent filed claim at court already then you are required to accept their offer. The court will not look favourably on you rejecting an offer of your charges in full and your claim may be regarded as an abuse of process in order to obtain interest. It isnt a right and is awarded at the discretion of the judge as part of a claim.

Don't let them keep more than £2.50 per charge!In fact I'd go as far to say, Don't let them keep more than £2.50 per charge date!! Max charge I got was £650
How are we expected to fund this kind of charge if we have family?

Hi,
I'm new on here but have been reading stuff from MSE for ages and am in the process of trying to reclaim charges.
However, it is now 41 days since they received my letter asking for my bank charge history and I've got nothing yet. I tried ringing yesterday (days 40) and today (day 41). Generally i got nowhere, but today I was told that the information I requested didn't come under the Data Protection Act so they didn't need to stick to the 40 days. (they did say that the stuff went in the post on the 21st - it's now the 26th and there's still nothing).
That just got me mad, so I did what some people suggested and messaged the bank on their own site from 'My Messages on e-banking.' I also got annoyed enough to send an official complaint to the Info. Comm.
Anyway, thats been posted, so please don't tell me not to do it!!!!
I was also told on the phone that the bank has an 8 week policy for replying to letters saying that legal proceedings are going to be started. I'm assuming that is just playing for time as Martin-Money-God-and-Friends say to stick to your own timetable, not theirs. Is this right???????
Hope someone can help. And does everyone have visions of appearing in court, losing and having to pay up thousands? Or am I with everyone else who knows diddly-squat about legal stuff.

And P.S. Does anyone know why, or even if, the Info. Comm. Office is going easy on the banks for breaching our rights under the Data Protection Act?
Surely the law is the law - would a hotel escape being shut down by environmental health on the grounds that their usual cleaner is sick but will be back in next weekend and the rats can wait till then?????0 -

Agreed with above advice and remember they are liable to repay your court costs in addition to any settlement of your charges.0 -
hi i am cuurently trying to claim bank charges apx £1400 and have started court proceedings nat west have offered about £500 before i started proceedings now that i have n/west have offered £500 + court fee £120 and now i have a letter from their solicitor giving notice of intention to defend shoul i be worried or is this the norm

No-one is saying the ICO are "going easy" on the banks but they are as busy as the banks in dealing with complaints and are dealing with this by sending out complaints to the banks on a monthly basis.
My advice to get your statements/info is to keep phoning/email/camp on the doorstep until you get this information.
You need to read the thread relevant to your bank as to how they handle the reclaims as HSBC, RBS and Natwest will send an offer in the 8 week timescale and its often best to just wait for that.
