    Bank: Abbey
    Amount Claimed: £4500
    Amount Paid: £4700 (including charges)
Story: I started in february and used the letters on this site, Abbey tried to stall at every stage - asking for more time to investigate etc, but I stuck to the dates and eventually went to Moneyclaimonline. Abbey filed a defence so the hearing was moved to my local court (I had to pay another fee), and then the date of the hearing was set for 16th August. We were given till the 10th June to submit any final documents to the court, and on 7th June Abbey caved in and said that while admitting no liability, they had decided to settle in full, including the charges.

Don't wimp out - stick to your guns and you'll get it all back!:rotfl:

I am about to send back the questionaire back to the court (against abbey) just wondering you say about final documents when you get the hearing date, what documents does that entail. i'm claiming for £6250 they have offerd 65% £4052 is it worth holding out?
    Any advice would be helpful

Twinkly - I seem to remember you were at a similar stage to me with NatWest. My hearing a week on Wednesday. Bundles sent to court and cobbetts. Where are you up to? JG
Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

OMG I think yours must be the quickest one I've read about on here! I sent my first letter to HSBC around the same time, and have decided to wait the 8 weeks - here's hoping I hear sooner rather than later.......I wonder if they're putting more people on it to clear the back-log? Well done - enjoy spending it!:D

Firstly let me explain something....I left LloydsTsb and joined Nationwide just after christmas, the manager at Nationwide knew why I was joining them and leaving LTSB, he quite catagorically stated, we have paid out to claimants because we know we wont win in court, now that was a new bank manager telling me, the only thing he did say was....You MUST exhaust it inhouse first before claiming albeit the FOS or Court...he is such a nice man lol

    hope that helps

    Not me sorry
  • Just been to court today in Kingston with A & L for an allocation hearing, they turned up and the judge has asked both parties to come back on the 25th July.

Can anyone tell me what this means and what should happen next?

    EVENTUALLY!!!!

I have a partial offer made.. out of the £4200 the Shabbey have offered £840 which we ahve accepted as part settlement.. so that should be in my account in the next few days...

My dilemma now is do I pay the people who are charging us mad interest rates (credit cards and storecards and the like) or do I pay off the overdraft like I said I would??
