Reclaim Unfair Bank Charges article discussion Part II

Hi all,
I hope someone can give me some advice, this month i had a cheque bounce and so there was no money in the bank to pay my direct debits ( i`m with Halifax) but the bank paid half of them and refused half but still charged me for all of them an average of £39.00, to make matters worse when i phoned them to explain what had happened they told me it was my problem and that they were also going to charge me a further £150 PER WEEK until i paid in full and that should i not pay promptly i will be black marked as a bad payer which will affect my credit rating. This could cause serious problems for me as i am about to apply for a second mortgage.
Desperately needing advice.
Many thanks for reading this.
Dreadful SCARE TACTICS BY HALIFAX. An appalling way to do business
Consider this as threatening behaviour by Halifax. A serious offence by them and one not approved by the OFT or the FSA.
Considering they are in no position to make such threats because THEY have applied unlawful charges to your account, write TODAY recorded delivery and advise that you consider their intended actions threatening.
At the top of your letter write COMPLAINT
Ask them to provide you with a full breakdown of how they calculate the charges applied and how they calculate £150 per week which can only be deemed as a PENALTY charge which in law is "unlawful" and they cannot recover that from you.
Duly advise them that should they attempt to affect your credit rating due to unlawful charges being applied you will take action against them. You also reserve the right to bring this serious issue to the attention of a judge for his consideration and that you will also ask the court to request from Hailfax a complete breakdown of their charges.
Further threats whilst waiting for this information will only lead to a severe complaint to the OFT, the FSA and the DTI

No fee, no bundle, no legaleesee and they can deal with cases and make awards up to 100,000 that can be as binding on the company as a win in court. So far we have won 100% of all cases with fos and have not seen anything from other sources suggesting otherwise. Timescale from submission of complaint form to completion are dragging out now to 3-6months due to increasing volumes but a lot less hassle
Thanks Defender
Encouraging to hear that! I really didn't want the hassle of court (although will if no joy with FO) Have now asked for £9922 with int = £12K!!! Timescales sound about right, as I suppose as more people complain as they are, the longer it takes. Might have some cash for Xmas then?!!! :rotfl:

Hi
Sorry if this has already been answered somewhere else
but I have just received copies of my statements from the last six years from Barclays, and I'm wondering if it's just the charges for transactions put through when I was over my overdraft limit or are there any others ?
thanks Carol0 -
Hi martin, just wondering if the law applying to bank charges also apply to mobile phone roaming charges. As you probably know there are debates that the amount charged by phone networks is disproportionate when making calls abroad.what do you think?0

With all respect due to Cyberman, great answer, I just have additional advice to give.
As advised here:
My Answer
Get written confirmation of the telephone call first. Once you send a complaint you are greenlighting them to delay reply by 8 weeks if they choose to do so. They are allowed 8 weeks to respond to and deal with a complaint and generally take as long as possible.
Given that this matter is worrying you so much I would gather as much information from them in writing as possible first before stating your case for complaint. Good luck with it
