Hi meatloaf, there are legal arguments in support of claiming beyond 6 years which seem to be based on the principal of concealment, and due to such concealment, the banks defence under the Limitation Act wouldn't apply.
If you do a search of the forum for "Limitation Act" hopefully you should find something useful, also there are a few threads on people who have successfully claimed beyond 6 years over at the CAG site.0 -

Thank you for your reply.
With Martins POC template, is it enough info to put on the Court Claim Form as POC?Its just that Ive read that some people might get their claims struck off because they are not providing enough info in their POC.
Which one would you recommmend?
When I phone them on Monday am I allowed to cancel so I can redo it with the recommended POC thats if the Martins one that Ive used is not good enough? I sent it online late Fri night just gone
Appreciate you getting back to me.
I would point out that your only error is to put a % sign instead of a £ sign. It seems a bit drastic to make you redo the whole thing. But they may make you start again, as another member has suggested.
As for the POC, i have handled 9 cases, and used a combination of Martins POC and the CAG. They have been good to me so far, but the again, i have never had to goto court with them.
You can't make too may changes anyway, as the MCOL site won't let you use too many words.0 -
Hi kayla,
I too am using the FOS. I passed my case to them after getting 2 decline letters for 2 accounts from the BOS on the 56th day. I forwarded it to them a week ago today. Can I ask you how long roughly it took for them to get a result? They have acknowledged my claim and advised that it can take 6 to 9 months. I hope it doesn't take this long, as I first asked for statements in January!!
Thanks Izzy0 -
i know i can claim back the £35 charges but can i also put on the £8 per day unauthorised overdraft fees?
thanks in advance

Thank you every body for your replies.
So is this right?
Im using Martins POC.
No4: Under the County Courts Act,the claimant is entitled to interest of 8% per annum from the date they were deprived of the money. This totals (Insert interest calculated from calculator),accuring at the dailt rate 0f (for me it would be 0.27) until judgement or payment.
So would I put £0.27?
im not sure if Martins made 2 mistakes on his POC.I might be totally wrong but on Martins it says accruing at the daily rate of 0.021% until judgment or payment.
Has Martin made a mistake by not putting ( work out your Daily Rate) ? Hes not used any brackets with & (work out your Daily Rate inside).Hes put 0.021 when it should be the rate youve worked out.
Also shouldnt it say on No:4 Under SECTION 69 of the County Courts Act 1984 instead of Under the County Courts Act?
Like I said I might be wrong.
Thank you.0 -
