    It's great to chat to people and get advice :D

    Wow thats ages ago beginning of april, nearly 3 months, thats when I started my claim but I filed MCOL in May :rotfl: because my letters were just being ignored - typical Lloyds TSB :rolleyes:

    I don't think there is a template letter for it, write one yourself, put your name address contact number and account number and sort code on it, keep it short and simple but straight to the point. All you really need is as i said above.

    we are also trying for barclays but are only in the early stages at the moment.

    No not yet, they defended both my claims but the judge has ordered them to be struck out so they have 14 days to object to the strike out :D

    I've just .... today .... received my barclays statements so i'll be on a mission tonight against them once I get home from work :rotfl:

    I have received this form in the post today requesting details to be sent to the court and HSBC who my claim is against. Can someone please clarify what this particular is requesting?

    "... 1c. A statement of evidence of all matters relied upon as tending to show the charges are irrecoverable as penalties or otherwise...."


    Everything else seems fairly straight forward. I am glad to see that a request has been passed to HSBC to produce a copy of the contractual document relied upon, and proof of cost of such losses

    Normally i would say don't worry, but some banks are very good at making their defence based on errors.

    Hopefully, MCOL is closed until Monday morning. If you ring them early, they might be able to change it. You will need your claim number. I would just change the '%' to a '£'. They might say it does not matter at this stage.

    You must phone before 10am. I would phone at 9am.

    I am not sure of the importance of the error, so hopefully someone on here will put your mind at rest.

    But if you ask for help in future, you must wait for an answer - your case could depend on it.

    Try The Consumer Action Group aswell, then you might get the answer a bit quicker.

    At what stage did you get a settlement? We have a court date for 23rd July and have to put court bundle in by 9th July

    hi - did they offer you less than that amount at first? i've had an offer (after threatening with court) but its nowhere near what i'm claiming

    Chase the buggars for the rest of your money! I claimed £800 from Lloyds TSB including the cost of issuing the claim via MCOL, and stuck it out to get the full refund - which I got. I think them offering you less than half of what you're claiming for is a bit of a cheek, and just shows they're still trying to get away with it. Also of course, the fact that they are making you an offer at all is surely an admission of guilt on their part. If you are in a position to stick it out to get what you've asked for, I would - but that is down to you. Good luck anyway!

    Since the above quote was made I have received an offer of half of my bank account claim!! (£142.50). Is it still worth my while going for the whole amount with interest? If so, which is the best route to take, The Financial Ombudsman or straight to court?

    I have had contact back on the Credit Card claim which was as expected, a We don't think we have done anything wrong sort of reply, and I have sent a second letter to them informing them that i am not satisfied with their response etc. as per the formatted letters on here. Would I treat these as two seperate claims if i take them both to the courts? one claim is £361.00 and the other is £1250.00. There is talk of credit card claims maybe more of a problem getting the whole amount back!! can anyone shed any light on this please.
