Hi,
I'm in the process of reclaiming bank charges from Lloyds TSB and started my claim back in March. The Small Claims Court has finally allocated the case to a local court (Lowestoft) as of the 14th June and they have immediately set a date for a preliminary hearing to take place on the 25th September. I thought this seemed a long delay!! Is this normal proceedure for the courts to take??0 -
Can anyone tell me, i have a court case for the 3/8 and have been asked to serve and file own statements etc and copy of any documents i wish to rely on by the 18/6 and then 5 days before hearing file and serve my skeleton argument - that is the written note as to relevant legal principles that apply to the claim.
Which is classed as the court bundle and should i have included the T&C;s already, if so can i add them in my skeleton argument.

started claim with mcol on 19/03/07,won judgment on 10/5/07,Lloyd's always maintain there charges were just and and that they hung on till the last minute,just checked the bank today and money was in.

Hi, i started MCOL on 23rd April, TSB filed a defence and today i have received an order from the court stating that i have to send to them within 28 days a list of all charges and original statements, which isnt a problem but they then go on to ask for
"a statement of evidence of all matters relied upon as tending to show that the charges are irrecovrable as penalies or otherwise" and "copies of all decided and other legal materials to be relied upon"
I dont know what this really means and wondered if you got this form and how far it went, did you actually go to Court? Im really worried that i will end up in Court and lose now0 -

I filed a claim with MCOL for £3,000 from Lloyds TSB, they filed a defence then the court was transferred to another court.
Today i have received a General Form of Judgement or Order asking me to send all sorts of stuff to them and the defendant...... some of it i can like a schedule of the charges and copy statements, but they are also asking for:
"a statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise and
"copies of all decided and other legal materials to be relied upon"
It then goes on to say that if i dont comply with this order within 28 days of 21st June, my claim will be struck out.!!!
Im totally confused and terrified of going to Court and losing as i really dont understand what i have to do - please help me0 -
I have had a letter off LloydsTSB today offering me £750 in goodwill. they said it would be in my account within 10 days. i was actually claiming £1660+interest which amounted to £1938.70.
obviously i'm not happy with their offer, although i am pleased it's a positive move from Lloyds.
what should i do now?

Hi can anyone help made a small booboo when issued MCOL to natwest . the amount asked was slightly out due to some date & cost calculations i'm down by about £10 on my claim (in their favour).
however i oked the info on MCOL as correct i'm wrong in their eyes by signing the sheet as true.
Cobbetts are asking for more info by 29th june should i pull out of proceeding further.0 -

i originally wrote at the beginning of April asking for the refund and detailing the costs. they said i 'agreed to pay' these costs (cheek!!). i wrote back demanding the refund and threatening them with court. then i received the offer this morning.

Wow thats ages ago beginning of april, nearly 3 months, thats when I started my claim but I filed MCOL in May :rotfl: because my letters were just being ignored - typical Lloyds TSB :rolleyes:
I don't think there is a template letter for it, write one yourself, put your name address contact number and account number and sort code on it, keep it short and simple but straight to the point. All you really need is as i said above.
