  • :undecided Hi All, first time on the forum, but I have been using Martins advice & letters for reclaiming bank charges. I am claiming £4982 plus interest, total: £6018 from Alliance & Leicester. On 29th May sent them letter stating I would accept 25% less [£4500] if settled within 14 days. Received a letter dated 1st June saying they are looking into my complaint and will contact me shortly. 14 days was up on 13th June. I know the next step is to fill in form for the small claims court, but didnt really think it would get this far. Maybe I was being a bit naive but thought they would have settled by now.

    Two questions:
Can anyone give any advice on best tactic to fight my case on the Court forms? All help needed [I'm not very good at filling in official forms!]

What experience have you had, [good or bad] if your claim is with Alliance & Leicester? I don't really see their name mentioned much on this website regarding people winning their claim from them.

You'll find the wording of your Particulars of Claim, POC, in the Reclaim Help Thread which is linked in my signature. You'll also find a link to the thread for the Alliance and Leicester with plenty people going through the same stage and you can read their experiences there.

    Hi angie7,

Strongly suggest that you treat each account as a seperate issue. Therefore, YES, pay the £10 three times. It is very little to what you'll get back. Make certain for each of the three, you send the letters by recorded delivery.

WHY ... because you will probably get different answers back on each account. It still seems the Banks have left hands that have not a clue what the right hand is doing. I have 3 accounts which I treated as seperate entities. Each reply differed and came from from different offices. This enabled me to play the bank with their own game, it confused them so much so that now, they don't have a logical answer for me. In due course, I will place this in front of a judge

I strongly suggest that you dont treat the three accounts as seperate for the purposes of accessing your mothers data. There is only one fee payable of £10 for all three accounts with the same bank and there is absolutely no valid reason whatsoever to incur yourself unneccessary extra costs at this stage. There is no benefit to you to pay £30 + postage when you only need pay £10 + postage. It will not affect the outcome of your claim at all to ask for this information seperately.

By all means treat each account seperately when it comes to writing your claim letters, you will have to anyway as each account IS a seperate issue.
  • Do I or dont I

I have been trying to recoup £3100+interest from the bank for charges, they have sent me a letter offering £2600. Do I take it or do I fight it further??
  • Hi,

After listening to Martin on Radio 1 I decided that it was about time to reclaim the 5000 plus that I have been charged by my bank over the past 4 years.

So after writing to the bank, who did not respond I filed a cliam with the local court and now have had a letter from the banks solicitors. In this they have requested additional information namely, " In relation to each charge please indetiny (a) the date whenthe charge was applied; (b) the amount of the same; and (c) the reason(s) given for charging the same"

In my claim form to the court I stated that the charges are "unlawful at common law and under statute and consumer regulations" and so the solicitor is asking under which sections of those I am referring to.

Therefore could someone please advise me whether or not I need to specify each and every charge and under which statute and comsumer regulations sections I need to state that their charges are unlawful.

    Mant thanks

    Hi,
I have gone through the whole process of reclaiming bank charges online and was pleased when money claim online allowed me to file for judgement by default. I have gone online today to see the progression of the judgement and my claim has been REJECTED. It's telling me that I am unable to take any further action online on this claim.
Please can someone advise as tyo why this might have happened and what, if anything, I can do next.
    Thanks in anticipation.

    Amount claimed: £2278.00
    Date of rejection 18/06/07
