  • first time i have posted anything so please be kind. My bank has charged me £105 for three d/d that weren't paid there was more than enough money in my bank to pay for them but they said because it was uncleared cheques that there was no way i was getting away with not paying the £105 but two days later the bank took a d/d out of my account and the cheques still weren't cleared can i fight this to get my money back ?? :mad:

    HI,
    having sent my letter asking for my money back from barclays(£3197) in total with out interest on the on the 16th may,i received a letter back from them saying it could take 6 weeks to look into it,which i think is pretty standard,i only gave them the 14 days as martin suggested,i then sent the next letter threatening court action on the 1st june,and as yet i have not recieved a reply from them:mad:
    What is my next action!!!
    I am also at the same stage with natwest although this account is closed,we are asking for £3100 back,we owe them £1800!!!!

    can any one help..:confused:

  • Mandy the answer is yes, have a read of the guide to claiming charges back, You can claim up to 6 years worth of charges, so if they are the only charges then you can start by sending a letter asking for those charges back.

  • Hi there folks!! well I was granted all my charges back, but i'm still paying off my loan to them in a seperate payment plan, so as a result of this they wont pay me my money back in a cheque it will go straight into the bank to pay off the debt but i dont want that money to do that the payment plan is doing that. Do I have a chance of winning this battle? ANYONE?
  • Tooty fruity the answer is no but the payment plan should end earlier. It sounds like a current account still exists racking up funds until such a point as there is sufficient funds to clear the loan. The debt will be paid off quicker. However, if you want a cheque for the charges as well as interest you would have to sue the bank BUT a judge may not look kindly on a claim that has been offered a full refund and declined due to wanting a different payment method.

    Hello,

    I am new here and require some help from you experts. My Mother has three bank accounts with LTSB and is owned thosands of pounds in bank charges across them. I understand that a £10 fee needs to be paid in order to access the bank charges from the bank, however, does she need to pay 3 x £10 as they are with the same bank?

    If all 3 accounts are in 1 name at 1 address then you can role them up into 1 claim and so only 1x £10 is needed ;)

    However, you may want to split the claims if you goto court as better rules apply if the claim is under £5,000 and it's cheeper in the long run if a single claim is below £1,500!

    This is very common practice by the banks. Its all about making you trying to accept a lower offer!! YOU need to stick to YOUR time scales! (as advised by Martin in his article) That means you should have entered it with the court on the 1st June!

    HOWEVER (hint hint) I recently told Intelligent Finance I would be taking them to court and when the date came I was short of cash in my bank so I had to wait for some money :o When I knew the money was on its way to my account, I wrote to I.F. telling them that I would have cleared funds in my account in 7 days time and at that point I would be taking it to court! I told them exactly how much they would save (8% interest & court cost that they would have to pay me back) if they settled now. They responded within 7 days offering me the FULL AMOUNT of my claim (without interest). Point to note: You can add interest to your claim as you enter it into the court system even if you have not mentioned it before! ;)
