    Bizarre! I wonder if they string this out for long enough whether they are intending to raise questions as to whether the notice to terminate is impliedly revoked (ironically) by the failure to use the PAC code as presumably, if you don't use it, your line will remain active with T-Mobile and you will continue to be billed.

    The mess just seems to deepen at every turn...

    It is now 2.9%. When the price increase was brought in it was at 3.3%.

    i think its a conspiracy nearly 1/2% fall TM having a guess at the rate ahead of time and no contact from them

    No, the latest RPI figures bear no relevance to anyone's right to cancel.
  • RPI is a flawed measure of inflation consistently overstating it. That was recently proved and ignored. See this link:

    RPI is flawed. But as per am earlier post of mine if RPI is 3.3% and wage inflation index is only at 1.1% for the same period - then is that not proof enough of material detriment?

    There should be no need to prove your income only rose by 1.1% (or less than 3.3%) as there is need for TM to prove their costs went up by 3.3%!!!

    Not sure how the above would play out, but I would give it a go if I TM had not given the PST Oct 12 customers such a strong "get out" by using the wrong RPI.

    Copy in Ofcom and add the below to your email (same goes for everyone -in fact for EVERY EMAIL you send TM copy in Ofcom and add the below)

    "in regards to Ofcom reference 1234851904 I want to complain about the manner in which TM has applied its T&Cs in its 2013 price rise."

    Dear Mr Swantee,

    As I have not heard back from my email below I assume T-Mobile still intend to ILLEGALLY remove the sum of £246.98 from my account tomorrow for issuing a PAC code (which has not been used) which was ONLY EVER requested on a PENALTY FREE BASIS as T-Mobile have increased my contract by 3.3% when clause 7.2.3.3 only allows a rise of 3.2%. I have now written 4 times (7 May, 12 May, 17 May and now again, plus I called customer services on 9 May) informing you that this charge should not be made.

    Your total disregard for the rights of your customers in not only illegally taking sums from our accounts (it is not just me), but totally DISREGARDING TMs own T&Cs both in terms of what is and is not allowed in relation to RPI AND customers rights to withhold payments as per the T&Cs as we are in genuine dispute, shows a company that is using BULLY BOY tactics to try and frighten its customers into submission.

    For your information I WILL CONTINUE TO FIGHT THIS CASE UNTIL OFCOM, AND ED VAZEY, WAKE UP AND TAKE ACTION! I will also continue to push to get some media attention focussed on T-Mobile and its appalling behaviour!


    NOTE to Media: Please email me to find out all the twists and turns T-Mobile have been using to prevent customers exercising their rights to cancel their contracts penalty free INCLUDING getting the (so called) INDEPENDENT arbitrator (CISAS) to put cases on hold pending an appeal by T-Mobile over the adjudication being heard! (Ofcom are aware and are happy for this situation to continue!).

    I would suggest using "unlawfully" rather than "illegally".

    I added OFCOM in on my last email, and might just rewrite and send a copy of yours to the same list as well.
