    A minor point that may or may not be relevant:

    - The reason T-Mobile (and the other networks) have a clause in the contract that they can increase prices mid contract is because prices may go up in future and they cannot predict how much (i.e. cannot predict the future)... yet they are using the argument that they did predict the future by using a 'no yet announced' RPI.

    - Also I doubt there is any mileage in it, but by allowing themselves the right to increase the contract price by RPI but not allowing the customer the right to decrease the contract price by RPI (i.e. when it is negative), are T-Mobile not making the contract unfairly stacked in their favour?

    Probably all irrelevant but thought i'd float it in case it adds anything.

    did they agree to cancel or did they just paste the usual, sorry u cant cancel without paying termination fees etc?


    Yes, the contract is cancelled.

    They sent me an automatically generated bill when I used the PAC code that included an early termination charge. They warned me this would happen though and have now put a hold on the bill until t-mobile respond to the letter. I really like their call centre in the Philipines.

    I'm thinking that if they insist that an early termination charge is due (as they are with you guys), then I will argue my case for a while then offer to send them a deadlock letter and advise them of their right to refer the case to the CISAS.

    Just wondering if anyone has had any luck. I emailed and sent a letter to T-Mobile on the 8th May and have not heard anything back at all. I was just wondering how I should proceed. The email/ letter was formatted in that suggested by the forum.

    Its worth spending time reading back through the thread to get the advice, but I appreciate it is long and time consuming.

    Ultimately it is your goal to get T-Mobile to allow you to cancel free of charge (I imagine) or to cancel your price rise possibly?

    They are very unlikely to do either of these so you need to complain to the executive office if not done so already.

    After the Executive office fob you off, you either need a letter of deadlock from them (again unlikely) or words to the effect of "we won't / may not reply to further correspondence from you" or "you are free to seek independent advice". If none of that then you need to wait 8 weeks to pass.

    Then you can go to CISAS who should independently take on your complaint and mediate between you and t-mobile before deciding on a course of action which you can accept or reject.

    If you reject it then its small claims court..... accept and the matter is pretty much concluded.

    In terms of the actual points to argue, check back in the thread for much useful advice - its not as simple as arguing "they have put their prices up and its unfair".....

    If you chose not to use your PAC your account will continue to be billed monthly as normal.

    T-Mobile and CISAS have both received a sharply worded email tonight.

    Just have a look/search through the thread looking at RandomCurve's posts, might be quicker than waiting for someone to post them all again.

    Have CISAS substantively decided your case in your favour or have you won (subject to the T-Mobile/CISAS corporate huddle) by default, i.e. T-Mobile's failure to respond?
