    Very true.

    "In some customers' eyes, the 3.3% rise was therefore above inflation." It should be blatantly obvious to MSE that 3.3% IS higher than the RPI of 3.2% :mad:

    Yes true, but with any luck it will make many more people aware of the situation and put them in a position to cancel.

    Agreed, I think the problem is Martin Lewis was the driving force behind MSE, with him off chasing his media career (and cheap Tesco Toblerone bars ;) ) the people left behind are just career journos without the drive to really go after consumer issues.

    All they want to do is report the news without rocking the boat, not fight for consumers.

    How ridiculous.... I suspect I and a good few others will get the same then. Its as if they don't want to act....

    On a different subject, does anyone have an e-mail address for Ofcom that definitely works? I used on poster earlier in the thread but it bounced back. I have also tried their online form but it doesn't seem to submit the complaint.

    Try 'OCCtelecoms@ofcom.org.uk' I have not had bounce backs from this address

    Maybe we're being victims of our own success and overloading CISAS with the number of complaints.

    Latest email from T-Mobile:

    I am sorry you remain unhappy however as I have provided confirmation of our position your complaint is not upheld and with regret any further communication regarding this matter may not be responded to.

    I trust I have confirmed me final position on this matter.

    I guess back to CISAS

    Well as I think I said in an earlier post - it is because the big companies bully us and those supposed to protect us (OFCOM)don't that I am pursuing this. My disappointment with MSE is that they have selectively quoted the email missing out that those who can cancel -which I will prove (with the help of others) we ALL can.

    The good thing to come from this is that it PROVES what I posted earlier - you are unlikely to win this is if you argue about the rate. The rate is almost irrelevant to winning this argument (I think I said "I know this sounds crazy but....").

    This is distracting me from finishing the case that needs to be followed so I will bow out shortly to get that finished (it is over 10 pages of A4 PLUS copies of T-Mobile emails). And at some stage I will give full credit to all those who have assisted.

    I will however put the preface to the case on the Forum to give those who think hey can win on rate alone a feel for what is needed.

    Please continue to send T-Mobile your cancellations - this is another trap to limit the number who request cancellation, and if possible hold of on your CISAS applications for now.

    Can I ask that YOU STOP sending media emails for a while as I may need to compile some new ones - and one just for MSE which you ALL need to send.

    Mine said "EE will not be communicating further with you regarding this issue" I guess a subtle difference. Maybe T-Mobile lawyers are proof reading the emails before they go out, to confuse the issue.

    I'd keep at T-Mobile until they don't reply, then try CISAS again. Point out Ofcom's Code of Practice.

    Here Is the "preamble" to the PRE Oct 2012 contract.


    Before I start this email I must state up front that I have no legal training, the points below are my honest opinions based on what I have seen of T-Mobiles (TM) actions and what Ihave researched (with others). It is up to you if you use all or any of the points below and I can take no responsibility for the outcome of your dispute with TM.

    This will be long and it will be confusing – sorry, but TM has (in my opinion) deliberately set out to make it this way! But by the end of the email you will see that is EXACTLY WHY you should be able to win this one.

    Unfortunately I think you will have to use ALL of the arguments below as it builds the picture that you need (you can probably just copy and paste – or print and attach – to your CISAS application). I suggest you read through the whole email once without trying to understand it, and then re-read it as it will make more sense in understanding the earlier points if you have read the whole thing.

    The contract appears to give TM the right to increase the contract by a rate no higher than the RPI rate for the month immediately before the month TM write to you. TM wrote to you stating 3.3% - and it has transpired that the March rate was indeed 3.3% - so an argument against the rate will I think be a difficult case to argue. Given this we need to look at the wider factors, your claim should be based on ...............
