Tmobile price increase

somewhere in the back of my mind (vast and empty most of the time) i remember getting an email off T mobile that the terms and conditions were changing with a link to the new ones, got to be honest i cant find a copy of it but wouldn't that mean we are all on post Octobers T&C0 -
Unless T-Mobile have right to choose different RPI's as I mentioned before for pre and post October customers then both cases are clear cut, it's just that approach will be different, wouldn't you agree?
I think T-Mobile are on a hiding to nothing which ever way you cut it (but that is just my view).
The IMPORTANT point at the moment is:
to ensure that EVERYBODY contacts T-Mobile to cancel before 9th MAY,
as whilst a victory for each of us individually will be sweet, how much sweeter that victory will be if so many left that it caused the ever silent Mr Swantee :wave: (I've looked him up on the internet and there is a picture so I suppose he does exist) to be paraded in front of the TV cameras trying to tell us what a really decent company EE is and what great discount he will offer if we stay!
We can sort out the legal details after 9th May.

As for the PAC code part, requesting a PAC code does not close the contract, only if USE it - unless they are changing that rules on that too!!! And of course you won't use it until they clarify that it is penalty free!!
I would think that the fact it contains "final" confirms deadlock, however I have two emails saying they have "I have confirmed my position" which CISAS say is not sufficient. They suggest I keep complaining until an email confirming "deadlock" is received, or wait 8 weeks.
As the executive office now seem to be ignoring me it looks like I'll have to go back to emailing Olaf Swantee and everyone else on the board.0 -

I tend to keep all my emails but can't find anything regarding a change of terms - after a full search. They could have sent letters out, of course, in that case it would probably have been binned or lost in the post.0 -

i purchased a fixed price contract for two years, at no time did any one tell me the price could go up, so i cared not a jot when they put the price up i cancelled my contract yes i used the clause because it was in breach.
all further letters will now state they broke a fixed price contract end of story, #480 is dead right we need to stand up as consumers for our rights.
so if you were sold a contract for 1,2 or more years, if you weren't told the price could increase and you believed you costs would be X each month then they have broken the contract and no amount of small print will help them.
Sorry, but this is bad advice.
It is not a fixed price contract, it is a fixed term contract. The terms and conditions you agreed to when you took out the contract gives them permission to increase your price plan, but only if certain conditions are met.
Using your PAC code and not paying the bills will result in defaults being added to credit files and debt collectors instructed.
I know you have done it this way, but I urge and beg other people not to do it this way.
Write letters/emails to T-Mobile/EE. Take the matter to CISAS or the small claims court.0 -

i was told by tmobile when i renewed my contract it was fixed price for two years i asked because i had herd of price increases by other providers. as i was about to leave them they offered me such a good deal i re signed.0

I think that important question to answer is whether T-Mobile is allowed to use two different RPI's-one for pre October customers and other for post October customers.
If you look at post October customers terms you will see that it does refer to PUBLISHED RPI which at the time of notice was February one.
Also Orange plays key role as well. You can interpret your terms as you like but there is only one fact and you can't change it.

The answer to your question is yes, there is no reason why T-Mobile can't use different RPIs for different sets of Ts & Cs. Why shouldn't they (albeit that when they gave the notice they obviously never intended to)?0 -
Whilst Watchdog never quite hit the spot yesterday (It is oniplayer now) re T-Mobile mis-timing it’s cancellation letter at least it has brought the dirty tricks of the mobile phone industry into the spot light again.
As it is always best to “strike whilst the iron is hot” and as I assume you all have thousands of texts in your contracts that you never use PLEASE use JUST one of those texts to Text watchdog [May not be part of allowance - cost me 25p]– if enough of us text they will probably do an update on next week’s show. If we keep the text short and broadly similar it will grab more attention. I have already emailed Watchdog twice over the last couple of weeks (I’m sure others have too) and will do so again before Monday –if you want to email as well that would be even better [EMAIL="Watchdog@bbc.co.uk"]Watchdog@bbc.co.uk[/EMAIL] I texted this morning from my “3” phone so if you have other phones in the house – text them from them all!
Texts should be sent to 83199 and begin WD as follows:
WD TMobile currentprice rise higher than RPI? Board guess RPI rate! Customers to cancel contracts? Please see emails that others have sent to Watchdog for details.
As per my posts #508 and #513 get those cancellation requests in - don't wait for TMobile to give a decision before trying to cancel - there is no way they will admit they are wrong until after the 9th May (if at all - and if they are).
