Is it too late to get involved in this?
Good question!
You only have 30 days to request termination if they impose an increase higher than the RPI as that is a breach of their own T&Cs.
However, in this case the WAY that have breached their own T&Cs also breaches the UTCCRs - and I think you have a 6 year time limit on that so I think you can put in a claim.
Any legal eagles out there with a better understanding of this?0 -
Anyone know how to delete selected messages from your PM rather than just emptying the folder?0

i know it wont be for everyone but for those who use little its a fantastic offer, no more monthly fees:)
Just had a look - seems too good to be true - what is the catch? and what is the coverage like?

Tick the check box on the right hand side next to the message. At the bottom of the page where it says "Selected Messages" in the drop down box choose delete.0 -

You pay £15 for the sim card, but you receive that back as calling credit when you register the sim. There's also a £3 bonus credit for transferring your mobile number.
It most definitely beats paying money over to TM each month0 -

Actually there is a catch:
3.2 Use of the service is dependent on receiving marketing messages from OVIVO Mobile. This is a mandatory opt in requirement and if not acceptable, then OVIVO Mobile will terminate the service and if required, allow the mobile number to be ported out
9.2 No opt-out to receiving targeted marketing messages is available
9.5 By registering or activating an Account with Ovivo Mobile, you consent to Ovivo Mobile collecting, processing and sharing Personal Data provided by you or generated in the course of supplying the Services to you, including details of voice calls, messages or data that you have sent (“Traffic Data”) and the geographic position of your GSM mobile telephone (“Location Data”) for the purpose of: 9.5.1 Supplying the Products and Services to you
9.5.5 Market research and profiling your usage and purchase preferences
As I read it somewhere in short you accept for Ovivo to collect all your personal data to send you adverts.
Not sure about you guys but I am not that fond about accepting that sort of contractbut its just me.

Another success! Pre-October contract.
Got an email today saying my claim was successful. Adjudicator was Richard Stephens. His decision was as follows;
I direct that
a. The customer is entitled to terminate the contract immediately without penalty; and
b. The company shall provide a PAC code as soon as possible.
He somewhat strangely did not accept that T-Mobile should have to pay backdated charges from date I first informed them of my intent to cancel. In his words;
j. I do not see that the company should refund all charges since the request for termination: the customer has had the service since then, and would have had to pay something...
I find this last point a bit strange as I could have been on a sim only deal and would have been saving quite alot from what I currently pay monthly. Suppose i'll have to accept the decision as is. I think the CISAS system is flawed in this way but nevermind, I'm pretty happy with the result.
Thanks to all in the forum for their help over the last month or so. Very much appreciated.
I am a bit confused as to what to do now though. Will T-Mobile get in touch with the PAC?0 -

Congratulations :j
Have you accepted yet? They shouldn't issue the PAC until you have accepted the decision.
They should then issue it without you requesting it, but there would be no harm in you chasing. Accept CS or Retentions are unlikely to know about the decision so will initially put a charge on your account for the early termination.
Personally I'm waiting for SIM unlock codes before I accept the decision, but then my decision is back-dated, so waiting costs me nothing.0
