Another success, but not quite what I was expecting.
Mr Richard Stephens agrees that I should receive a pax code penalty free but no refund of charges paid since April since I've had use of the service.
Also no compensation for poor customer,

Contracts up in early September so only days away from requesting my pac anyway.

Have you accepted yet? They shouldn't issue the PAC until you have accepted the decision.
They should then issue it without you requesting it, but there would be no harm in you chasing. Accept CS or Retentions are unlikely to know about the decision so will initially put a charge on your account for the early termination.
Personally I'm waiting for SIM unlock codes before I accept the decision, but then my decision is back-dated, so waiting costs me nothing.

I haven't got to that stage yet, but I think others have posted that PAC Codes turn up quite quickly (within a couple of days), however refunds, when owed, take a little longer.
However, when back-dated it is in TM interest to get the PAC Codes used as soon as possible.

The trouble being that nobody at the company seems to know who/what CISAS is (from what i've read on this forum) and there seems to be no notes on file regarding the claim decision. I wouldn't even know who to phone or email at this point.0 -

The decision not to back date is wrong in my opinion but at this point I'm just happy it's all over. It's a shame your so close to the end of contract though.0 -
Congratulations on your win, however what an appalling decision. The contract was breached, its not your fault tmobile decided not to comply with their terms and conditions and cancel it when requested back in April.
I'm still waiting on my result, however if I get the same result as you two - cancellation with no backdated charges, I would be instigating small claims court proceedings.

I feel a bit hard done by the adujicators decision.
I have accepted the decision as I begrudge giving TM any more money but was wondering could I still make a claim via the Small Claim Courts for the money I have paid since April to T-Mobile.0 -
Actually there is a catch:
3.2 Use of the service is dependent on receiving marketing messages from OVIVO Mobile. This is a mandatory opt in requirement and if not acceptable, then OVIVO Mobile will terminate the service and if required, allow the mobile number to be ported out
9.2 No opt-out to receiving targeted marketing messages is available
9.5 By registering or activating an Account with Ovivo Mobile, you consent to Ovivo Mobile collecting, processing and sharing Personal Data provided by you or generated in the course of supplying the Services to you, including details of voice calls, messages or data that you have sent (“Traffic Data”) and the geographic position of your GSM mobile telephone (“Location Data”) for the purpose of: 9.5.1 Supplying the Products and Services to you
9.5.5 Market research and profiling your usage and purchase preferences
As I read it somewhere in short you accept for Ovivo to collect all your personal data to send you adverts.
Not sure about you guys but I am not that fond about accepting that sort of contractbut its just me.
but i guess everyone as their opinion on things, personally ive had no issues with OVIVO and for Free EVERY MONTH u cant go wrong for those who dont use much0 -

Not true I'm afraid or at least not in my case. Judgement accepted 10 days ago and still no contact from EE.
Even emailed their Exec on Sunday and no response yet. However I'm getting a backdated refund so no real rush. If I wasn't getting backdated then I'd just ring CS and get my PAC and use it asap. The charge for it can be disputed / cancelled later.A big believer in karma, you get what you give :A

Absolutely. Its what I would be doing in your situation.
Its clear from the adjudicators decision that T-Mobile have breached the terms and conditions, otherwise he would not have ordered them to cancel the contract penalty free.
You had no choice but to keep paying them since April, even though they breached the t&c's and refused your cancellation request.
A very poor decision by the adjudicator.0
