    Does that include international calling too ? for some thief to see you a bit *tipsy* or you losing the phone/sim and someone thinking they call round the world at your expense...


    Be careful, I think they (EE) screw you over if this worst happens...you get no discount or credit to help clear any fraud balance (as you had your £200 prepaid - they wont say it but they will think it!)

    Back a few years ago some of you may remember that T-Mobile went to change the FUP on data. I was one of those affected and so terminated my contract. As many of you have experienced it isn't the easiest thing to do.

    I had all the usual barriers put in front of me but still I went ahead and terminated the contract. I quoted their own t&cs, ofcom regulations but still they wouldn't let me go with no charge.

    After 2 years of fighting, debt collectors and a default on my credit file T-Mobile have seen sense and removed the default and cleared the balance.

    I would never ever point people to T-Mobile and it has pretty much put me off getting a contract with a phone supplied for life. You hold the power with a sim free contract, the more people that do it the better.

    I'm sorry but could someone explain how the RPI for march has changed to 3.3% now so I can put it in my response to tmobs defense, I'd left this whole mess for a bit and now am struggling to piece things back together

    I would small claims that damage to your credit file, upto £5000 ;)

    I received my decision yesterday & won it - PAC & refund of all charges since notice was given, thanks to those who posted on this forum with their actions.

    Miss Justine Mensa-Bonsu was my adjudicator & as with most others ruled that the T&C's were ambiguous & therefore the customer wins.

    Judging by the response I've been sent I think CISAS are taking a line out of TMobile's book, it's the same as d123's, no complaints from me - if TM can submit the same defense then why shouldn't CISAS reply in the same manner.

    I kept my response to their defense simple & ignored most of the fud that TM replied with:

    please find below my response to T-Mobile’s defense. To simplify matters I have only responded to sections of the defense provided which I feel are in dispute.

    My argument is centered around section 7.1.4 of their Terms & Conditions which mandates a minimum notice of price increase being 30 days & section 7.2.3.3 which allows for penalty free termination.

    (a) Clause 7.2.3.3 - The change that We gave You Written Notice of in point 7.1.4 is an increase in Your Price Plan Charge (as a percentage) higher than any increase in the Retail Price Index (also calculated as a percentage) for the 12 months before the month in which We send You Written Notice and You give Us notice to immediately cancel this Agreement before the change takes effect.
    I do not dispute that T-Mobile is permitted to make a business decision to increase their pricing.

    However the contract is quite clear that 30 days notice must be given to increase pricing, the increase took effect on the 9th May 2013, therefore notice would have to be served no later than 9th April 2013.

    The rate of RPI in force at this time (9th April 2013) was 3.2% (as listed in T-Mobiles defense in section 19, the March figures were not released until the 16th April 2013), I do not believe this to be in dispute, however for the sake of clarity & it’s relevance to this case I have restated it.

    Following receiving T-Mobile’s letter & taking further advice I contacted them on the 30th April to request penalty free termination on contract (as per 7.2.3.3) because of the above RPI price rise, this request was refused, I was offered the option to leave with penalty but declined.

    T-Mobile appear to be basing their position on a future RPI rate (as it was not released at the time they chose to write to me), their own contract does not make provision for this, therefore the only relevant RPI can be the February figure of 3.2% as it was the current RPI figure at the time the letter had to be served (9th April, February figures released 19th March, March figures released 16th April).

    I therefore request that you find T-Mobile in breach of their own contract, they release me from contract immediately, supply my PAC code & refund all payments made from the 30th April when I first engaged in dialog with them about this issue.

    Just waiting for my PAC & refund now (which is reasonably sizable as I've been overseas for a few weeks since this started & racked up some roaming charges) & enjoying the free services until they send it to me, I accepted their decision by phone yesterday & have had confirmation from CISAS as such. I'd not normally gloat but EE's executive office seems to exist to be rude & mess customers around, they've clearly not changed from the Orange days, but have not had a good effect on TM's customers.

    In all fairness the Orange EE team have always been pushed to the edge by CEO office, they follow instructions from CEO and Legal Teams on such matters, given they then got millions more customers with T-Mobile they must be stressed to the max repeating CEO and Legal Teams and are stuck as piggy in the middle (no defence for rudeness, if you cant hack the stress your employer place find a new job whoever your employer is). EE will not back down, that's the Orange way enforced on T-Mobile customers they will take it as far as they can because the smugs in Legal Team think they are superior beings because they have law degrees and actually if CEO seen the figures spent & coming back from CISIAS a few heads would roll like Orange's.

    My experience of Orange changing aterm I did not agree ended up with the *cough* Legal Team trying to change another term to change another term to change another to enforce the first, and my legal reply was you by LEGISLATION have to give me 30 days notice of a change of T&C for the first change, and everyone after you are using in your defence to justify the first non notified change. I got a letter saying I was correct and PAC was being processed.

    The Legal Team are idiots, a contact who was on Sainsburys legal team previous laughed when they seen the patheticness of Orange Legal Team trying to confuse a customer but doing it to themselves to then back down, he didn't believe me what went on so he got the paperwork.

    The high profile very legal eagle from Sainsbury's professional opinion was that Orange "legal team" individual would have been stripped of professional privilege for blatant misconduct had I reported it, because everything was a lie in 'writing' and they just trying to deny the customer cancelation as if "they were a judge ruling with
    law on their side", but they weren't and I knew this and I succeeded, frankly that team one day are going to cost EE UK absolute millions in damages for breaches of law and a marketing campaign money cant buy - everythingeverywhere but not enough customers to stay floating.


    EE want you to go to CISAS because they want to grind you down, and last thing EE want is a court appearance - and customers in the past have won by default as EE/Orange wont send someone to defend their "legal teams" actions (no wonder, I'd be to embarrassed as a "legal" professional to stand and be ripped apart by a judge in a court knowing my actions were wrong).
