The Legal Team are idiots
To think that their legal eagles are being paid ridiculous amounts of money (or perhaps some have now received their P45's?), the way the Legal Team has blundered its way through this mess is shocking. When they first announced the prediction of RPI theory, I was shocked, but glad that they did, because who in their right mind (apart from a legally trained one) would think that is reasonable?
It looks like, thanks to the the Legal Team, EE's grave has been well and truly dug out (over this issue anyway). Of course, it's ultimately down to Mr Swantee , but what's the chances of him going? Nowt.0 -

Ofcom are still busy sitting on their hands with the good old line...
"We can't act on individual cases but we do monitor the volume of each type of case and can get involved where there is a particularly large number of complaints..."
Wish I could get away with that type of response in my job.....
I agree that these wins will mean next to nothing to T-Mobile as they still do very well out of it, but hopefully these famous victories will at least teach a few people to fight when they believe they are being wronged.... anyone remember the posts on this thread in the early days effectively calling us all idiots for moaning about a few pence a month price rises....A big believer in karma, you get what you give :A
If you find my posts useful, "pay it forward" and help someone else out, that's how places like MSE can be so successful.0 -
If I was CEO of EE, with a 52 million win and a few thousand loss from CISAS cases and small claims, I would be celebrating my legal team / Executive for a job well done!
Although the cost of cases at CISAS may be insignificant in the context of a £52m gain, many customers who didn't have the inclination to fight TM will choose to walk away when their contracts are up - it would take less than 100,000 customers, or 5% of the customer base, to wipe out their £50m gain
There could also still be financial repercussions for TM from Ofcom over the issue (although this seems unlikely given Ofcom's lack of backbone).Consumers are still waiting for Ofcom to end this. It is expected consumers will be allowed to leave penalty free if there is a prise rise, but what's taking Ofcom so long to do this ?!0 -
Can anybody advise whether as somebody who was aware of the price increases, however of course hasn’t reviewed their terms and conditions like an idiot, is it too late to request a cancellation and refund?
I despise EE/T Mobile with a passion, they are a awful network with terrible customer service and I never hardly ever have a signal, so if I could get out of it now, for free before my contract runs out next March then I’d appreciate it! If not nevermind0 -

Unfortunately the bandwagon has now moved on.
7.2.3.3 - The change that We gave You Written Notice of in point 7.1.4 is an increase in Your Price Plan Charge (as a percentage) higher than any increase in the Retail Price Index (also calculated as a percentage) for the 12 months before the month in which We send You Written Notice and You give Us notice to immediately cancel this Agreement before the change takes effect.
In terms of 7.2.3.3 the notice to cancel is required before the increase takes effect. As soon as you became aware of the increase you should have notified T-Mobile of your rejection of the increase and advised you want to immediately terminate.====0 -

Thought as much, nevermind, i'll grin and bear the last 7 months or whatever0 -
I am watching some of the comments and find them amusing. I really do not understand how can someone complaint about having the price increased mid term if
a) Bar one or two operators everyone does it
b) I do not recollect whether I have received paper version of terms & conditions but I know that by opening my phone and starting using my card I accept the terms which are available to read and are not hidden
- as such I do not understand how someone can sign 24 month contract without reading terms & conditions - it is daft to not read it.
T-Mobile did make a mistake and I am not happy with their tactics to hide that fact and as such made my case and won but having said that I think that T-Mobile is one of the best operators for my type of usage - ie. unlimited internet on mobile and no charges if you go over limit like it is with Vodafone or O2.
If I would decide to go for new mobile I would go with T-Mobile again to be honest but I think I am done with having the best and newest phone for now so will go for Sim Only deal.
Now if you say why not buy phone separately - well not sure about others but I do not have a 400£ upfront to splash out and with a contract I have the 0% APR finance given for the mobile and get a SIM with loads of minutes, txts and internet on top of that.0
