speeding

Hi everyone


I am New to this forum and i hop you can help.

Just received a letter on Friday 15/3/2013 from police asking to confirm the drive of my car within 28 day or else, The car was caught doing 35MPH on Springwell road,Sunderland which is a dual carriageway even the sign say that but no warning of what the speed limit is.

I was driving that day and i have been back to springwell road and could not find anything to say what the speed limit at all i have taken a video which i will show you what i am talking about.


Like i said i was only doing 35MPH as i thought i was 40MPH as the other Road connecting to springwell road are 40. Please help

    Streetlamps in a built up area and no signs the the contrary is usually a safe bet that the limit is 30mph.

    It looks like it goes right through the middle of a housing estate too.

    Just looked at google streetview - 30mph signs as you enter the road.......sorry.

    I have been back twice i even took a video but the is no sign of any speed limit sign on that road at all at all which i cant understand . I have been on side of the law since 1998 i passed my test .... i thought ill do 35 to be better the 40 which i thought it was

    Do you have the Envelope ?
    what is the date of offence on the NIP and what is the date on the postmark on the envelope.
    Is it within 14 days ?

    Speed signs are current until they are cancelled so if it is 30 on other roads and you turn in, it is 30 until it is cancelled out by another sign.

    When you receive an NIP the Envelope is the first line of defence and often the first thing people throw away. .

    Cool, now prepare your case. If there's no signs ... then shove it to them & good luck :)
    Web detectives using google maps are obviously better than a camera in the car :D

    EDIT: although spacey has a point.

    The road i was driving before i turned was Durham Road which is 40,the date was 5/3/13 and i received it on 15/3/13

    The NIP is correctly served.
    You would need evidence to show that the 40 mph limit was not cancelled anywhere between the last 40 mph sign or repeater marker and the point at which you were measured.
    if any 30 mph sign are between those points, you are kippered.
    It would have to be continuous footage from point to point at a quality admissible under evidence rules and submitted with a signed affidavit that the footage was not altered in any way.
    And I have probably got carpeted for telling you this.
